    Was your connecting flight arranged by Virgin?

    I suspect not, and if that's the case, then you won't be able to claim I'm afraid, your second leg of the trip would not fall under the jurisdiction of EC261

    All flights were through Virgin booked through ebookers. The flight that was cancelled was a virgin flight but operated by Delta and was cancelled due to "storm" Juno.

    Hmmmm, it's not a straight forward case, if for example you book a flight from London to Sydney and the airline decides to split your flight in Singapore then you might just possibly have a claim under the actual EC261/2004 regs (if the Singapore flight was delayed) but actually receiving compo is another matter, opinion is split on the forum JP would, no doubt, fight your corner 100% but I'm less convinced, if you really wanted try a good NWNF Sols see if they're interested, if they are then perhaps you have a case, but I fear the obstacles in your way may be a mountain to climb, get your mountain climbing gear on or give up!

    just got 2 cheques from virgin for VS16 26 MARCH 2014 for£450 each, we first complained in april 2014 told we had no complaint theY did give us air miles we said they were useless to us so after a few letters they gave us £150 worth of duty free vouchers which you could also use to book flights we tried to use them to upgrade our seats after a lot of hassle with virgin they upgraded us for free, we tried for compensation again after recent court ruling and we got it plus free upgrades both ways back to orlando and £150 duty free vouchers as well ALL THANKS TO THIS SITE AND THE PEOPLE ON IT THANK YOU VERY MUCH
  • Hello, just wondering if I have right to claim compensation against Virgin Atlantic.

    I was due to fly to Las Vegas on the 29th December on flight VS43. Soon after take off a fault developed with the landing gear. We circled over the south west coast and jettisoned fuel before returning to Gatwick. We circled for a few hours here, while carrying out manoeuvres to try and dislodge the landing gear. This didn't work and we had to make an emergency landing.

    A new flight was put on the following day but some of the party weren't ready to fly again.

    Is there any chance of a claim?

    Absolutely, and welcome to the forum btw, Yes sounds like you had a technical problem with the plane and thanks to the Huzar SC judgement, you are covered, start by reading Vaubans guide than come back and ask any unanswered questions you might have.

    I think they classed the situation as an extraordinary circumstance initially and don't think this has changed. We haven't received any update of the issue since it took place. But I have read some of cases and it seems that this now falls under technical fault that's within their xontrol? Is this correct?

    I don't really know where to begin with all of this lol.

    You may be better going down the NWNF solicitors route.

    Bott and Co are highly recommended by many here, including myself, although there are many others available.

    However, I have read on MSE that you can claim back to 2005, but with more difficulty.

    Can anyone tell me if they have had success getting compensation beyond the 6 year limit and how they went about it ?

    That information is misleading, the legal deadline is 6 years. After that you can ask, but they are under on legal obligation to pay you.... so they won't.
