Hi Capi,

Sounds as though they ARE claiming an EC. Bad weather is a genuine EC, IF that was the true cause of your delay, and you very possibly won't find out until you commence Court proceedings.

Researching other flights, is absolutely the right thing to do now the next step is to read Vaubans guide, then come back and ask any unanswered questions you may have.

Didn't think they could claim that if it was the incoming flight that had problems ?, I also think they will use weather as a excuse but surely that's a lame one for ec in this case as all other flights were coming in and out normally from Manchester that day including their own earlier flight to Orlando left on time a hour before ? Also isn't it a bit lame the crew had to drive to Birmingham to get the plane fly it to Manchester that arrived at 12 pm (was originally 8:30) into Manchester but then that crew would have been out of hours so had to wait for another crew change to arrive 7 hrs later and we then got to Orlando eventually 6 hrs Late , just hoping as there was 5 of us on the flight and would make up for the grief of the day at the airport with 2 young children... Also as I haven't heard anything yet at all how long do I give them as over the 28 days as stated on their website and not even had a acknowledgement from them , it was sent recorded so I know they received the forms , time for a nba?

Is that you stand a fighting chance but it WILL NOT be straightforward, have a bl00dy good read of that excellent guide by Vauban and make your own mind up, on what your next steps are.

I believe that by law they are only allowed 3 attempts before they have to divert to another airfield.

So by definition your flight (VS073) was effected by a knock on delay.

Due to the length of the incoming flight from Orlando it also seems plausible that the flight crew were out of hours etc etc

Which all means you are entitled to claim 600 euros for each of your party that qualifies. See Vaubans guide for more details.
