Is it accepted by easyJet that a delay (3½ hours) caused by bad weather on a previous flight is grounds for compensation?

I have read that there was a 'non-binding' court case some months ago.

Not a question of what Easyjet think. Reg 261/2004 says only "meteorological conditions incompatible with the operation of the flight concerned".

I know, but I had read that they said they hadn't accepted the court decision as binding at the time and wondered whether anyone had experience of claiming from them since then.

    Have you made a claim?

I am referring to the legislation, not a court decision. The law says weather can be a significant factor in relation to a particular flight. It seems reasonable to interpret this as meaning weather problems on a previous flight can't be. As you will be aware, there is currently no binding UK case law on the whole issue of flight delay compensation so your best bet, in my view, is to stick with the primary legislation.

(If it's an EU decision, it will be binding. If it's a non-UK european counry decision, it won't be.)

I've only just become aware that I might be due anything (having read Martin's last email more closely than usual!), so thought I would start here to see if anyone had been successful under these circumstances before I tried easyJet.

Looking at people's postings, easyJet seem to be - or were - one of the better airlines for paying out. But there's not a huge amount of consistency across any of the airlines - some people get their compensation straight away, and others are refused (and occasionally for the same flight).

So I would make the claim in the first instance and see what happens, then come back here if you still need help.
  • Hi,
I was one of the unfortunate one's that was caught up in the debacle on Christmas Eve at Gatwick Airport and am considering raising a civil case against Gatwick Airport Limited & Easyjet (I will NOT be accepting Gatwick's feeble offer of £100 vouchers!!!)
This is not just about claiming back all the lost monies but making them accept that that treated us worse than animals and had a responsibility and a "duty of care" to look after us.
We were only given 1 bottle of water in the 18 hours we were there.
If anyone has any advice or want to join me and create a joint case - please contact me.
    Thanks
    JM

Did you have a contract/agreement with Gatwick airport?
Posts are not advice and must not be relied upon.

Did somebody tie firecrackers to your tail? Or cut off dangly bits to stop you breeding? Or stuff you full of anabolic steroids to make you meatier? Did they harpoon you or club you? I think your language too colourful and I think your chances of winning a case against the airport because an act of God overstretched their resources infinitesimally small. However, you did enter into a contract with EasyJet and they were obliged to honour the terms of the contract even though events were beyond their control. You may care to read the article linked below and then you too can choose to fight a court case for years to get back your airfares or whatever. You may care to remember, however, that nobody set out to inconvenience you and it was a bad day everybody. Life is a rich tapestry of experience.
