    Many thanks for this reply.

Would you suggest pursuing based on their inability to source a different plane, or continue with them having claimed "technical fault"? Or both?

So do the CAA keep records of delays?

Apologies if it's an obvious question, but this whole thing is new to me.

Again, apologies if obvious, but how do I go about this?

I live in Scotland, so if I were to take the court route, where would I lodge the claim? Dundee Sheriff Court (where I live) or Luton County Court (where EasyJet are based)? And does it make a difference due to the separate legal systems?

Edited to add: something else that occurred to me - it was a a business trip that I claimed on expenses. Would it be worth my while mentioning this in a reply to EasyJet, saying that I'll have no hesitation in directing the claim to the legal department of my employer? My intention had been to keep this private (which is allowed under the way our expenses work) but if putting into the system of a reasonably large organisation could carry weight, I'd be happy to do it on a point of principle, if nothing else.

Hi, i'm having exactly the same problem. Have now had 4 emails from easyjet claiming it was a Birdstrike (correct... for the 2nd aircraft) and LGCIU issue (a technical problem with the landing gear, relevant to the aircraft we were due to fly on).

The 4th email ended "Please accept this as a final response form easyJet on this matter. Thank you for choosing easyJet." so I am going to abandon pushing them directly and firstly pursue this though the CAA. The easyjet customer "service" team are obviously unable to look past their system generated responses - an effective defense against all but the simplest cases!

If anyone wants to pool resources for this case send me a PM, happy to share the emails I have sent/received so far.

Good luck with that - like the Great War, your claim won't be over by Xmas, as it's apparently taking the CAA six months to respond.

I got a fairly prompt reply from the CAA saying they hope to deal with my case "within 8 weeks". I'm not holding out much hope, but at least it's on the pile.
  • Hi I am new to this so here goes on monday the 8/7/2013 we had a 14 hr delay back from dalaman airport with easyjet. The captain came off the aeroplane and said they felt something with the rudder when landind, so the technical team would have to be flown out from england and an empty plane would come for us. We left dalaman at 13.45 on the 9/7 /2013 to fly bk to manchester. So my question is are we entitled to compensation? Even though they put us up in a hotel.

    Hi.

I need some help with EasyJet, as they are being very difficult and we have been trying to claim since last year.

Basically, husband and I were delayed around 24 hours in 2010. We contacted EasyJet to make a claim and they refused because they apparently have a 2 year window in which you can make claims, and this had passed.

We contacted the Spanish aviation authority people, as advised, and they sent us letters stating that we are entitled to 250 euros each because the reason for delay was NOT extraordinary circumstances. They said they would be sending a copy of the letter to EasyJet.

After weeks of emailing to EasyJet and getting no response, I received an email today stating that they would not pay us compensation because according to their records the delay WAS due to extraordinary circumstances!

I know this is just EasyJet trying to get out of paying, as I have looked at the list of extraordinary circumstances, and none of those things apply to our flight, which we were told was delayed due to lack of cabin crew.
It's also interesting (but not very surprising) that they seem to have changed their reason for not paying out.

Anyway, really hope you guys can give me some advice and tell me what I should do next!

    Thanks.

  • We had a delayed flight (3 hours 10 mins) and they have said it was safety reasons for the delay which is extraordinary circumstances. Dont believe it was that as it was never mentioned at the airport, on the plane or in the letter sent to us a few days later. In the airport they said the flight was behind shcedule and the time of arrival kept changing. When it did arrive, they got the passengers off that plane quickly, cleaned quickly and then us on, that doesnt sound like a safety reason to me.
What should do next? what does everyone think?

Little alternative other than to issue 14 day NBA then apply to Court.

Hi lottie, it's a small world. I came on here to see about claiming for my flight back from Tenerife on 9th July, which was delayed 3 hrs and 25 mins, due to technical reasons. When we were on the plane they said it was because our plane had had to go out to Dalaman earlier that day. :rotfl:
    Hope is not a strategy.
