    NBA = Notice before action
    LBA= Letter before action
    They are different names for the same thing. The essence is that you make it clear that you are giving them one final chance to settle your claim before starting court proceedings.
    It is important that
    1. You allow sufficient time for them to pay (we usually suggest 14 days)
    2. If they still refuse your claim or fail to reply you MUST issue court proceedings without any more letters, phone calls or emails. If you don't you will lose all credibility. So you should not send an LBA unless you are serious.

    Hi,
    Can anyone advise if it is worth continuing to claim for compensation after receiving the below email from Easyjet? If so, what would be the best way of going about it?

    Claim received: 11/06/2018
    Flight Number: EZY 8534
    Flight Date: 03/06/2018
    Scheduled Departure Airport: Naples (NAP)
    Scheduled Arrival Airport: London Gatwick (LGW)
    Claim decision: Declined
    Decision summary: We’re sorry that your flight to London Gatwick was cancelled. Our assessment and legal team has carefully reviewed your claim and the circumstances around your flight and have confirmed that your compensation claim is not eligible for compensation payment under EU Regulation EU261/2004. Please note that this may not match with the information you were given on the day of travel, as our staff in airports, and on-board, may not have had all the information concerning your cancelled flight.

    Our assessment of your claim
    To further explain what happened on the day; London Gatwick airport services experienced a systems failure that resulted in no check in facilities being available. Long delays built up during the day for all airlines as they waited for the problem to be rectified. Ultimately, in the case of your flight, the crew were pushed to their maximum legal operating hours. There are strict industry wide rules on the number of hours our crew is allowed to work. To protect the safety of our customers and crew, these hours cannot be exceeded. We had no alternative but to cancel your flight. We do take reasonable measures to avoid cancellations and delays to our flights by having replacement crews and spare aircraft available in our network. On the day, however, higher than expected levels of disruption meant that our replacement crews and spare aircraft had all been deployed by the time of your flight. The main reason for the cancellation was as a direct result of the airport systems failure.

    6 months after out initial claim to easyJet for cancelled flight, the adjudicator at CEDR has finally found in favour.
    EJ now have 28 days to pay up. Not holding my breath......

    It was slightly disappointing that EJ didn't submit its defence as it would have been interesting to see if the adjudicator factored in the second hurdle of unreasonable delay. The focus in the determination was that the EC didn't exist, as the proposed strike was called off.

    Following the 'Beast from the East' flight cancellations - in our case Prague to Bristol we successfully got flights refunded AND compensation for expenses. It wasn't easy. The CEDR route clinched it.
