    Hi, I wonder if anyone can help. EJ cancelled our flight 4 hours before take off on a Friday and informed us we had to log on to their website to book ourselves onto another flight. The next available flight (by the time we got onto the website) was on the Monday morning which we couldn't take due to family and work commitments. We booked onto a BA flight for the Friday which happened to be Business Class. I have written to EJ using your templates asking for some kind of compensation however they have responded saying:


    "Having reviewed your claim, we are unable to repay any of the claimed costs under EU Regulation 261/2004. Please see a breakdown of your claim below and the reasons for non-payment.

    Alternate Carrier: We will not be able to reimburse your alternate carrier claim as you have taken a flight with another airline using business class.

    For more information on the payment of reasonable expenses in times of delays or cancellations please visit:
    at-the-airport/delay-and-cancellations


    Once again, we are sorry for the cancellation of your flight and look forward to welcoming you on board again soon."


    I've been through the Regulation and their website but cannot see anything that says about the change of flight class. Am I missing it somewhere, is there anything else I can do?

    You certainly have a claim but you may have difficulty in persuading a Court to award compensation for business class, unless you tried every other alternative. It comes under the legal principle of mitigating one's loss. This means that where one party breaks a contract, the other, innocent party, has to keep her losses to a minimum. Were there no seats available in economy or with another airline apart from BA? If of course, there was no other option open to you (e.g you could have got a flight the following day but accommodation would have cost more) you may well win but don't expect Easyjet to pay without your taking them to Court. But you will need really compelling evidence.

    You should get at least what economy fare would have been. One difficulty would be establishing what ecomomy would have been as the fares fluctuate.
    You may also be due compensation under reg 261/2004 as your flight was cancelled.
    However we need alot more information:
    flight number, dates, times, departure/destination airport and the reason given for cancellation.

    Hi legal magpie, thanks for responding. The business class flight was actually cheaper that the economy flight that went later that day. I searched on skyscanner for flights and the BA flight was the top one. As it was basically last minute there wasn't much availability on that day. We had a family commitment on the following day which is why we returned on the original day (Friday).

    If you can prove that the flight you took was cheaper than any alternative, you won't have a problem. But proof maybe the issue. As I said post up all your flight details to help us help you.

    Hi JPears, thanks for responding. The letter I sent referred to the reg 261/2004 with all the flight information.

    There wasnt a reason given for the cancellation, I received a text message saying 'We're sorry to inform you that your flight has been cancelled. You can transfer onto a new flight, arrange a hotel room or get a refund here: easyjet . com / 8916.'

    Firstly EuClaim says you are due 400euro per person for the cancellation. What was the difference in price between your EasyJet flight and the BA flight? It would really help your cause if you could find out what the economy price was on the aircraft you flew home on.
