Flight delay and cancellation compensation, Easyjet ONLY

Why don't Judges give compensation if they believe the airlines have blatantly lied to the claimant let's say to the value of the claim. See how the airlines react to that.0

You cannot claim compensation twice for the same journey. You have only paid for one ticket/journey. Unless you actually claimed a refund for the cancelled first flight and booked/paid for the replacement flights?
Was the second flight actually cancelled or delayed?
What were the reasons for the cancellations/delays?
What is the distance of your flight by the great circle method? This, as well as the lngth of delay, to some extent, determines your compensation due.
I assume you got a refund as well for your unused tickets?
1 week later and there has been no response from easyJet.
JP -I don't actually agree with your advice. I don't think you are right. I am claiming for two EJ flights being delayed (within EJ control -ie faulty aircraft).
Cancelled is irrelevant in my opinion. I am quite aware of reading the 261 rules as the delay in any case was over 3 hours on a flight distance of 1500kms or greater.
To my mind the fact that it wasn't paid-for is irrelevant otherwise, EJ, or any other airline, could keep delaying/cancelling a flight for day after day and argue only the first one counts as you didn't pay for the re-scheduled flight. I was inconvenienced for 3 days, not 1 and, it is compensation!
Not really fair I think.0 -
However in this case, the OP didn't actually take the second flight......
throw that into the mix
We don't know for sure if it was just delayed, or cancelled.
We do know. It was cancelled, then delayed, then cancelled, then delayed until the day after (ps this is the second day flight originally cancelled from the first day and re-scheduled to the second day which eventually flew (without me on it) on the third day but at the time of cancellation (1800hrs at night) was not clear when it was flying. I felt entitled, while easyJet we messing everyone around, to make plans to get myself home as they were failing badly at doing what they are supposed to be experts at - getting people from a to b.0 -
Hi Frank,
I don't think the principle of claiming twice is clearly answered by the regs and I also don't believe there is any existing case law to rely upon.
However, there may be a suggestion that it is possible from this extract from the 'Better Enforcement' publication which are Interpretative Guidelines on Regulation (EC) No 261/2004.
Any new right to compensation according to Article 7 will apply to the re-routed flight accepted under Article 8(1)(b) or (c) if it is also cancelled or delayed at arrival (see Section 4.4.11).
My suggestion would be to contact EJ and ask for a breakdown of the compensation amount that they have offered for flight #1, it's clearly not right.
I would then ask EJ for a deadlock letter so that you can ask CEDR to look into Fight #2 for you. Once they have accepted your case you will get an opportunity to give feedback on EJ's defence. Quote the above guidelines and see what the adjudicator comes up with.
Good luck.
That all makes really good sense, if only requiring a lawyer, barrister, judge and several months pf time and vast amounts of cost to fight. But, we will see. Still 1 week on an no reply from EJ. Time to write to the CEO Ms Carolyn McCall0 -

Hi frankt3323,
What I was suggesting to you would cost the maximum of £25, and that is only payable to CEDR if you were to lose your appeal. The application paperwork should only take 30 - 60 minutes and you do not need the services of a lawyer etc. The whole process is very simple and you could easily do this yourself if you wanted to. We are always here to assist too.
I believe that Ms McCall is no longer CEO

Good luck whatever you decide to do.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Hi, We are currently mid claim against Easyjet via CEDR and to be fair the process isn't that bad. Just convert your documents / evidence to pdf files and then upload everything online. You get a case ref and link so can easily track progress.
Hoping for a good outcome as we have a similar story (to many others) with the ground staff (airport) and pilot (when we did eventually board 20 hours late) telling us one thing and then Easyjet customer services trying to say it was due to air traffic control.
Main reason for the post though is: Does anyone know if there is a central database of flights where you can put the details in (flight number / date) and bring up details of who has claimed off that flight already and also the outcome. It would rely on people uploading their stories of course but I'm sure people would.
I think this would be really useful and help people a lot. CEDR charge £25 only if the complaint fails but on this basis only one passenger would have to communicate their victory / or failure and we could all follow suit.
If such a thing does exist (which wouldn't surprise me) could someone tell me where it is? I did search the web but couldn't find anything.
If not can MSE set one up?0 -
Hi araeho - good luck with your claim, hope it all goes smoothly with CEDR.
Part of the raison d'etre of this board was to list up flight number claim successes for each airline. Unfortunately it never really happened as there are so so many delayed/cancelled flights over the years, it became impractical. If you're new. read The FAQ and Vauban's Guide
The alleged Ringleader.........0 -
Thanks JPears I'll definitely post an outcome on here including the flight number and date.
I get the volume issue and that's why a board such as this isn't probably the most appropriate way. Not saying I know the answer by the way but surely some techy person will could potentially come up with a solution which requires a bit of formatting (flight number / date) being input to add something to the database and then a search function.
Anyway just an idea which Im sure others have thought of!!
We will keep up the battle with Easyjet and hopefully come back with some good news0 -
Hello All,
I was recently delayed coming back from Milan to Edinburgh by 3 hours and 8 mins and I claimed compensation and to my surprise I was rewarded £450 in total (£225 per passenger). The airline was Easyjet.
However I want to know if I would have been entitled to more, given that the flight delay guide states if I was delayed 3+ hours and the distance of the flight was between 1500km and 3500km I would be entitled to €400 (£350).
Does this mean I should receive £350 per passenger or is it £350 a minimum between two passenger?
Kind Regards0 -
Milan (MXP) to Edinburgh (EDI) is less than 1500km so €250 per passenger is correct.0
