Hi everyone, looking for some advice:
Should I claim delay compensation or a refund?
Flight from London to Vienna was originally delayed by 1 hour, due to arrive 20:40. Mid-air, we were informed that we were landing at Frankfurt due to a fault with the fuel tank (fuel not transferring from one tank to somewhere else - thinking this is airline's fault, as it appears it was also the cause of the first delay).
Landed in Frankfurt at 22:00, no information until midnight. No EasyJet desk/staff at Frankfurt airport.
We needed to be Vienna by the morning, so we took a night train from Frankfurt to Vienna. Via text msg, EasyJet informed they were providing hotel & the flight from Frankfurt to Vienna would be the following day at 14:30 => so total delay of approx. 15+ hours
What can I claim in this situation?
1. cost of the easyJet flight (wouldn't this be a refund and then I wouldn't be able to claim for delay compensation?)
Given we didn't take the Frankfurt-Vie replacement flight and had to make our own way, in order to arrive on time + the flight we bought originally was supposed to take us to Vienna, but instead we arrived at a different destination?
2. train ticket to Vienna
3. we had booked 1night in a hotel in Vienna, which was charged, but we didn't use it. Can we claim for it?

Hi eriek,
You should claim for EC261 compensation (€250, as less than 1500km) for the delay, train ticket cost and any food plus drinks. You cannot claim for the hotel as it is not covered by the EC261 regs but you may be able to do this in the civil court using the Montreal Convention as the basis for your claim.
If EJ reject your claim you should ask CEDR to adjudicate on your behalf and include you hotel costs too. Haven't heard of anyone being awarded consequential losses by CEDR, such as hotels, to date but believe it may be possible so give it a try.

Hi I'm part of a group of people who were bumped off an EasyJet flight (some voluntarily and some involuntarily) from Santorini to Manchester earlier this week after a cabin crew member fell ill.
The flight was due to leave on Monday. Hubby and I were at the back of the queue, heard the tannoy announcement asking for volunteers for the sum of €400 and put ourselves forward. Once they had eventually got everyone they needed and put some very distressed people back on the flight they then handed out the document 'Your Entitlements (Volunteer or Involuntary Denied Boarding)'. Reading through the document it clearly sets out the amount we're owed in accordance with the EU regulation (€400 each) then at the bottom it states "In addition to the above compensation, customers who volunteer to give up their seat shall be given a discretionary bonus payment. The amount will be agreed between the customer and Easyjet in advance."
This is where I have a couple of queries:
1. Would this be the €400 the lady announced over the tannoy? As she did say for volunteering. However she was from the company 'Skyport' as there are no Easyjet staff at Santorini airport. Therefore would that still qualify as being agreed in advance?!
2. When we did eventually get to Manchester two days later we spoke to a lady on the customer service desk who then said we would get less for volunteering, this is something I've read elsewhere (I think on this site) however their document clearly states it would be in addition. However we've not actually spoken to any Easyjet staff in advance to agree it as there were none available.

It's an interesting question that you ask and I'm not 100% sure of the answer. The answer is further confused by them asking for volunteers prior to fully informing everyone of their EC261 rights.
If you had a document offering volunteers €400 in addition to €400 EC261 compensation then that would be pretty conclusive and remove all doubt. However, that is not the case, from what you say.
It may be that the verbal offer of €400 was in reference to the EC261 compensation, not in addition to it, so it's pretty unclear imo.
You need to contact EJ and question them, particularly with regard to the 'discretionary' amount offered to the volunteers.

Hello,
Easyjet have declined our claim for our delayed flight. We were due to fly to Venice from Gatwick on July 25th at 8:30pm. When we arrived to check-in the flight was announced it was delayed by an hour. Each hour then kept passing with another announcement it was delayed even further until we got to 11:30pm and it was announced our flight had been cancelled and we'd have to wait at the airport until 5:45am. The reason they gave us all night for the delays was due to a backlog of planes in Europe and then it was cancelled due to the crew exceeding their working hours.
The staff at Gatwick told us they couldn't get us a room anywhere for the night but when I kicked up a stink and informed them that it is illegal and that I am pregnant and can't sleep on a seat all night they eventually got us a room in a nearby hotel. We then caught the early flight the next morning.
The following day Easyjet emailed us to apologise for the delay and said it was due to a storm in Italy. At no point were we told this waiting at the airport. Also, when we arrived in Venice relatives told us that there was a storm but it only lasted less than an hour plus the flight was already delayed before the storm happened.
Is there anyway we have a claim? I feel like Easyjet are trying to squirm their way out of this. Thank you in advance for any help.

Should I write a 'notice before action' email to the CEO of SleazyJet as advised in the guide or contact CEDR as I've been seeing others do on here and getting some success with? Basically EJ have deceived us over the reasons for the cancellation initially saying it was a back long of planes, then the crew going over their hours then finally to it being bad weather! So many inconsistencies.0 -

Your next step should be to ask EJ for a 'deadlock' letter or wait 8 weeks from your initial claim, you can then refer your claim to CEDR who will adjudicate on your claim. From what I can deduce it seems perfectly valid.
This seems to be the quickest and easiest way forwards. You still have the option of litigation if that should fail for any reason.

So ezy138 on 16th July 2017 was cancelled at 11.15pm that evening. We were put into a hotel and got the same flight the following night. Reasons for cancellation at the time were given as crew issues.
I am pursuing compensation for my family of 4. Having read a lot through the forums I am aware easyjet may have a tendency to lie....
So the weather in Belfast and Manchester that day was pretty great - sunshine throughout the U.K in general. However, I received a deadlock letter 9 days ago refusing eu261 compensation on the grounds of weather (specifically thunderstorms so clearly not in the U.K.) I did not reply to the email but I am in the process of taking it further.
I then today receive another email from easyjet regarding compensation of expenses (£20) saying the cancellation was a result of air traffic control.
So are easyjet lying or could the reason for a cancellation be changed like this?0 -

I was due to fly from Belfast to Gatwick with my partner on Sunday 30/07/17 9pm. The flight was delayed while we were waiting, then delayed once again. Next thing they had cancelled the flight. We had to go to customer services and queue from 9:04pm until 11:32pm to get dealt with.
Eventually they told us they could put us on the next available flight which was on Tuesday 02/08/17 @ 4:20pm. They put us up in a hotel for 2 days. We had to pay for our own taxi. As a result we missed 2 days of work each.
I put in a claim for expenses incurred. I also put in a claim for compensation. Easyjet said at the time that their pilots had over gone their allowed flight time so the flight had to be cancelled. I got the following email yesterday in regards to my compensation claim.
Are they correct stating that I am not entitled to any form of compensation, 2 days of loss of earnings not even considered?

I have had a phonecall from easyJey executive support explaining to me that I was not entitled any compensation for my 44 hour flight delay/cancellation as it was due to an Air Traffic Control strike, even though at the time of the cancellation they explained to us that the issue was down to pilots having used up their flight time allowance.
They said they would refund any costs we had to cover (food, taxis) which they have partly agreed to do. But there are some bills they are not covering such as meals (as they were supplied by the hotel and we ate in a cheap cafe), I was not informed at anytime that meals would be covered by the hotel, when we checked in they told us breakfast was included. When we arrived at the hotel we ordered some food at 1am (4 hours after the flight was meant to leave) we had to pay an additional £5 for room service as the restaurant was now closed. Easyjet are not covering the £5 charge either, which means that we would have went 10 hours without food had we not have went with the room service option.
I complained some more and said I would still be trying to get some form of compensation, they then offered me a £150 voucher to book flights over the next 6 months. I am still not happy with this and will be trying for compensation but I fear I will get nothing due to them stating it was down to a strike.
Any advice would be welcome.0 -
paulport and paddyob. You have to understand that EJ have now taken the tactic of lying to you as their general MO, in the hope you will go away.
If you haven't already done so, download Vauban's most useful guide then plan your way forward.
Either diy legal action, NWNF firm, usch as Botts or try using the ADR for EJ - CEDR?
paddyob - the fact that they have offered you partial compensation says a whole lot. They know they are liable otherwise they wouldn't offer you anything.If you're new. read The FAQ and Vauban's Guide
