Well my NBA email was read by Carolyn last night (well I'm guessing not personally!) and this morning Customer Services have replied saying they're sending a cheque for 196.85 GBP !
I suppose it would be churlish to push for the 4y interest - assuming 8% compound interest that would make it another £70![FONT="] ;-)

Wondered if anyone can help.
We traveled back to London UK from Tel Aviv in September 2012. Our flight was delayed by just over 9 hours. The pilot stated (without any remorse) that a technical fault on an earlier flight had had a knock on effect on later flights, hence our delay.
Once home, I submitted a claim for compensation which was subsequently refused on grounds of extraordinary circumstances. At that point, I didn't pursue it further.
I decided to re-submit a few weeks ago, citing Huzur v Jet 2 and that technical faults do not constitute extraordinary circumstances.
Easyjet has subsequently admitted this was the case (ie. my flight delay was not due to 'extraordinary circumstances' however, they stated that we were not entitled to compensation as we did not take the flight!
Other than swimming home, we had no option but to take the flight!
After numerous emails back and forth, Easyjet is not relenting and still insists we were not on the flight, which is complete nonsense as there were no other flights to London during our 9 hour delay.
Unfortunately, I don't have boarding passes. I do have all my booking confirmations.
I was travelling with my husband and two children (8 and 4).
I've threatened them with court but they just won't play ball.
Any ideas?0 -
Read Vaubans Guide it is all explained even explains what to do if you don't have boarding passes. On the face of it your are due €2400. If you don't want to do this yourself you can use a No Win No Fee solicitor like Bott Co who will charge 27% of your total compensation plus a £25 admin fee each.

They know you were on the flight, they are just using whatever excuses they can to block your claim.
If the claim were to go to court, under the wording of EU261/2004 you only have to provide evidence to show that 'in the balance of probability' you presented yourselves for check-in.
The fact that you took the outbound flight when you booked a return swings that balance well in your favour, but anything else you could present as evidence will help seal the deal.... Do you have any stamps in your passport, credit card statements for duty-free / refreshments purchased at the airport or on the flight etc...
Threatening with court is no good unless you're prepared to follow it through & from what I've read below in your post you have a pretty strong case for a claim.
Your best bet would be to follow your threat through & start a claim, but your first step should be to issue an official Letter Before Action.
Download & read Vauban's guide if you haven't already.
Use the template to write your LBA, include reference to Huzar as previously, but also refer to Finnair v Lassooy (read this from the link in Vauban's guide - basically ruled that in the event of knock-on delays even E.C.'s can't get them out of paying up).

Old debt passed to collection agency? Issue CCA request & possibly have debt rendered unenforceable. Feb 2021 - £42 of old debt legally written off & cost £1 per account.0 -

Absolutely.
What Mooskey could also do is make a Subject Access Request under the Data Protection Act. That would oblige EJ to provide whatever information they do have about you. If that then contradicts what she was told, they might be more inclined to settle any claim pronto.0 -

We were to travel to Switzerland, but while on our way to the airport, received a text from EasyJet stating that the flight has been cancelled, due to Industrial Action in France.
We had a full trip booked and now the only way to get there is to pay another £500 per person through another airlines.
Should we book the more expensive tickets and then ask for a difference in ticket fares from EasyJet ? What would be the best course of action to proceed?
