I agree but proving that in court is going to require alot of evidence. There is a limit to the amount of traffic other spaces can accept too.
No harming in claiming, especially after 1 June as referral to CAA could cost the airline £150

I need some advice because I have never been to court and I don't know what to expect. I am one of 3 claimants (my husband and my son are the other 2) ,do we all have to be in court or I can just go by myself? What do I need to take with me (documents,paperwork,emails)? Good afternoon all,
I'm hoping someone can help me. I was recently delayed over 5 hours flying with easy jet from Newcastle to Barcelona. Because of the delay I was unable to check in to my hostel in Barcelona so therefore decided not to travel as I would have landed in Barcelona without accommodation in the early hours of the morning. Easy jet are refusing to compensate me under law 261/2004 as I did not get on the flight. I did however check in and wait for 5 hours in the departure lounge. I was wondering if this is right and if I am entitled to compensation. Thanks

Easy jet originally said I was entitled to compensation but then changed their mind when they later discovered that I didn't board the flight, despite me checking in. The flight was EZY6401 on the 6th May 2016. It was a navigational fault that they later changed to a crew issue, either way their fault.

Easyjet are lying (again).
Articles 6,7& 8 of reg 261/2004 deal with delays/cancellations and refunds/compensation. Your flight was delayed by 5 hours and 8 mins. After 5 hours you can obatian a full refund. After the Sturgeon Judgment, you can also claim your E250 compensation. Send a claim, noting it and an NBA with 2 weeks notice then fill in your NCOL court paper.
Might also now be worth mentioning you will refer to the CAA (after 1st June) if they don't settle promptly- they have no defense and it could potential cost them another £150 charged by CAA.If you're new. read The FAQ and Vauban's Guide

Hi,
so my family were due to fly to Spain tonight-literally unloading the cases at Gatwick and got a text saying our flight was cancelled. Apparently there were storms in Jersey which caused delays and meant the crew had worked too many air hours and now plane couldn't fly as no crew. EasyJet offered refund and we were told no flights until Tuesday /Wednesday ( awful customer service, no info, or help provided- but that's another story!) ...anyway, we came home and I have been online and applied for a refund.
I have telephoned the transfers we booked and they are now cancelled and the out of hours service "think" I may be able to get a refund if I phone in the morning and I have messaged the villa we booked to say we're now not coming.
At the airport, someone mentioned a form you can complete from E??? for compensation- does anyone know anything about this? Also I am worried that we may not be able to claim for the cost of the holiday on our insurance as it was not a package and everything was booked separately- therefore our accommodation (the villa) is "still available for us to use"....any advice much appreciated

EU261 is a fixed amount for the flight cancellation. For consequential losses like transfers and villa you should speak to your travel insurance. Which route were you flying? are there any flights on other airlines to still get your holiday?0
