Hi,
36hrs is a long time to be left waiting for the aircraft to be repaired. You could rightly argue that EJ could, and perhaps should, have got you back to Manchester much quicker than that. It is their responsibility to do everything within their powers to return you ASAP. Further, to claim an EC they must explain how and why they have come to that conclusion.
Botts calculator is correct, you would only qualify for 600 euros if the flight was over 3500km. AYT to MAN is 3136km.
You can DIY by following Vaubans guide, plus there are many regulars here who will always offer advice if and when you need it. In my opinion you have a very good case so give it a go!

Hi, I was on the same nightmare trip. I have looked on line and I can see recorded evidence of incidents with bird strikes But nothing for this delay. Do all bird strikes need recording?
I have contacted Easyjet and had the same response as Gecclestone. I have replied back again stating "I disagree with your statement. Bird strikes can no longer be used by airlines as one of the extraordinary circumstances defences against paying flight delay compensation under EU Regulation 261/2004. Bird strikes cannot be considered extraordinary because they happen several times a day.
As far as I can remember this bird strike struck and damaged the Radome. They pilot told us we wouldn't be flying as it would possibly take 2+ days to get a replacement Radome from Geneva. No Easyjet staff were seen to be "looking" after us.
On the plane on the way home, the Pilot stated the we never got a replacement Radome, as Airbus agreed a repair to the Radome. The repair was not carried out to the specifications required. Which is why we were delayed from the Sunday to Monday and then on to Tuesday morning.
My argument is Easyjet could have sent another plane to take us home and not had the full 36/37 hour delay.
We were treat to a lovely 5* hotel. With meals, and one soft drink allowed. Most of us didn't have money left at the end of our holiday. The hotel was quite expensive too! No phone calls were offered to us.
Most of us had also thrown our toiletries as they should have not been required. We were offered no toothpaste or anything else we might have needed.
I feel we could have been looked after better, and home a lot sooner.

Well other than the previous advice given to Gecclestone I would say PM (private message) that person and pool your resources. As they say, two heads are better than one!
You will probably have to start court proceeding either yourself or through a good quality NWNF claims solicitor.

Hi everyone,
I was wondering if there was any other way around this than what is advertised on the EasyJet site. I have booked a return flight to Manchester in two weeks time and am unable to board the first flight at 7am, to change this flight to a later time EasyJet are charging a £45 fee. Would it be possible simple to miss the first flight, book a later one and get the original return flight back?

I'd really appreciate some advice on whether I should take the following issue further or forget about it.
I'll make it brief but will gladly provide more details if it helps someone to guide me on this.
My flight from Zante to Liverpool was cancelled and rescheduled for the following day. I have been compensated for this by easyjet.
The following day the rescheduled flight was too heavy. The Captain came to the gate to explain that, in order to take off, he needed ten people to give up their seats. I was on my own and happy to give up my seat. We were booked onto a flight two days later to Gatwick, with an unspecified transfer to Liverpool. Taking the first cancelled flight out of the equation, I was still over 48 hours late arriving in Liverpool based on the rescheduled flight time.
I claimed for what I considered to be a separate incident from the first (cancelled) flight. I have taken my complaint through easyjet (still waiting for a reply Ms McCall), and as far as the Hellenic Aviation Authority. I've even gone down the no win no fee route. The response has been the same from them all: you can't claim twice for one booking.
OK, I booked a flight from Zante to Liverpool which was cancelled and for which I was adequately compensated. But didn't that part of the story end there, and the next bit start? The Swissport desk at Zante made a replacement booking for me which, due to easyjet's error, was not fulfilled.
So do I have a case? My opinion is that two flights failed me, and should be treated as two separate incidents. I'd love some views on this. Even if you think I've got it wrong, at least I can let it go instead of continuing to obsess over the whole thing.

I think the advice you have is right: you cannot claim for two incidents, as they both stem from the same booking.
I'd also add that it you agreed to give up your seat then you can't claim for that by definition as you were not involuntarily denied boarding.0 -

It would be unusual for volunteers to be offered nothing to give up their seats

Also you don't qualify for compensation if you did not pay anything for the ticket. Just as you cannot claim for a free infant place.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0

Thanks for the replies. I suppose I'll going to have to forget about it. I'm reluctantly starting to get my head around the reasons for refusal. My wife will be pleased, she bet me £10 I was wasting my time!
Re the volunteering, the Captain had said that if he didn't get 10 or 12 volunteers, the last 10 or 12 to check in would be denied a flight. I was in no particular hurry to get home so agreed. No incentive was offered although we did get two more nights in Zante with breakfast and evening meal courtesy of easyjet.
I can see that my volunteering doesn't help my case, but had the group of us not volunteered surely easyjet would instead have had to deal with claims from the people who were denied boarding?
And yes, the flight was free I suppose, having been compensated for the original cancellation. But isn't it more about the fact that easyjet caused me considerable inconvenience rather than the cost of the flight?0 -
I guess in this case, serious forumites might consider gaining a refund on the original, cancelled flight, book their own replacement, assuming the price differential wasn't massive, just in case this scenario occurs, making 2 compensation payments possible
My main concern would be the the aircraft was 10 passengers and their luggage too heavy! That's a considerable error ...If you're new. read The FAQ and Vauban's Guide
