Flight delay and cancellation compensation, Easyjet ONLY

Can't find specifics on this but how long after bad weather has cleared can an airline reasonably wait to reschedule. Madeira flight was delayed 27 hours. Scheduled for 18:55 departure but inbound couldn't land and went back to Edinburgh. Same for 2 flights from Manchester and Gatwick. Difference was that the other 2 were rescheduled to fly back to Madeira first thing in the morning departing back around 11AM from Funchal. But the Edinburgh flight wasn't rescheduled until 21:30. The rescheduling of the Edinburgh flight 10 hours later than the other 2 is to me an operational decision since they were happy the weather was OK in the morning.
Any precedents on this with Easyjet or other airlines? The rescheduled flight was less than an hour late, but the decision to reschedule so late caused overall a hugh delay.
AFAIA there isn't a precedent on this. And with a destination like Funchal it's going to be hard to argue for a short reschedule, - I mean because there's only one airport and not a choice like Luton Stanstead Gatwick Heathrow Southend all classed as 'London'.
But 27 hours is pretty long, worth going through the motions of a claim IMO.0 -
Hi there,
Just after some advice please regarding my claim which dates back to a flight from Sharm El Sheikh back to Luton in 2011 which I was turned down for compensation originally but I asked them to reassess last November, they have finally come back with this email reply as per below. The flight was diverted into Ciaro and we eventually took off the next teatime and arrived back in Luton 23 hours late the next day, below is the reply which as far as the smell of sulphur is concerned is correct.
It has been confirmed by our support team that the flight was diverted to Cairo overnight because the cabin crew could smell sulphur in the rear galley. Whilst the aircraft was being checked by engineers the crew went out of their permitted flying hours and as a result there was no other option that to delay the flight. As the time taken to check the aircraft was outside of our control and with the crew being out of hours, it would not have been safe to fly as planned.
I can appreciate this is a disappointing outcome for you, but I hope this explanation has helped.
I wish you an enjoyable weekend
I am quite prepared to take this as far as I can including small claims as it was a family booking for all five of us so a fair amount of money is involved. What are peoples thoughts on how successful I would be please?
All comments appreciated. ThanksUp the Rams !!0 -

Hi just looking for a view from 'the experts' regarding a flight delay suffered last night/this morning.
I'm not a novice at claiming compensation having successfully claimed twice against Monarch last year. I understand the process but would be interested in whether or not the reason given for delay justifies a claim.
EZY1976 was delayed by 3 hours and 42 minutes arriving in Manchester this morning at 05:07 against a scheduled arrival time of 01:25.
On boarding the plane in Paphos we were advised by the Captain that the delay was due to the following:
The incoming flight from Manchester to Paphos was delayed as when the aircraft arrived into Manchester from it's previous flight from Athens the passengers disembarking in Manchester were, due to a Ground Services error, allowed into the same area of Manchester Airport as was being occupied by the passengers waiting to board the flight to Paphos.
When Security at Manchester heard this they took all the passengers awaiting the outbound flight to Paphos into a separate Terminal Building and re undertook all the Security/Baggage checks. The Captain didn't state how much of a delay this caused but did state that Easyjet had then determined a 'standby' crew was required and they had been called out at around 17:00.
The outbound flight should have departed at 14:55 but didn't actually depart Manchester until 19:03.
Is there a case for compensation do people think or could Easyjet claim it was outside of their control?
Thanks in anticipation0 -
Easyjet had plenty of time to make alternative arrangements to minimise the knock on delay to your flight. For reasons best known to themselves, they chose not to do so. Compensation is therefore payable, in my view.0

The flight from Athens arrived at 13.56, so plenty of time to sort out. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Hi all, I was wondering if you had any advice on my query
My flight EZY556 last sunday (31/05) from Belfast to Newcastle was delayed for 4 hours and 33minutes , due to an earlier technical fault. This mean a landing time of 3.15am rather than 10.45pm. I checked the flight time before going to the airport and due to this delay, booked another flight for the following morning at 8am (so i could get some sleep before meetings the next day).
Easyjet have sent the following response to my claim:
"Further to your claim for EU Compensation, we now have the results of the delayed Report for Flight 556. Your flight was delayed due to Technical reasons. However under EC Regulation 261/2004 you did not take your flight, therefore you are not entitled to EU compensation. In order to get a refund of your delayed flight, it has to be delayed fo over 5 hours. Your flight was delayed for 4 hours and 33 minuets. Therefore a refund is not eligible."
Is this correct...? Surely I should be entitled to the refund of fare at least?
Thanks0 -

That's an interesting case, but I'm afraid the airline are actually correct on this occasion. In fact, unusually they have it spot on, 5 hours is the delay threshold for you NOT to travel and be entitled to compensation. Technically you chose not to fly, therefore cancelling your flight and Easyjets cancellation terms will apply as normal...
The only positive you can get from this is that you avoided an overnight sleep in the airport and at least you'll know a bit more about EC261/2004 next time.
