  • I have recently sent 2 e mails to Easyjet regarding a 14 hour delayed flight from Lanzarote to Liverpool. The first e-mail was through your flight delay link which has not been acknowledged by Easyjet. I also sent an e-mail via my own hotmail account which was acknowledged.

    Easyjet said they would be in touch within 7-10 days which is not the case as I sent the complaint in 17 days ago.

    Can anyone give me advice on the best way to pursue my claim.

  • I'm hoping for some advice, I'll TRY to keep this brief:
    I was booked on EasyJet flight EZY8794 from Rhodes to Gatwick on 1st June 2014, scheduled to depart at 22:40. The plane arrived and offloaded more-or-less on time. After some waiting we were told there was a technical problem (I think it was a sensor which indicated, erroneously, a loss of cabin pressure) which they hoped they could fix. Later we were told that the technical problem could not be fixed quickly so EasyJet would fly a replacement plane to us and it would depart from Rhodes at 14:00 the next day – then EasyJet arranged for transfers, hotel rooms and meals.
    The next day we were taken back to the airport to find that EasyJet had not provided a replacement plane but they had flown out a replacement part and the engineers were working on the original plane. We were then told that the flight, now re-numbered as EZY9794, would depart at 17:00 not at 14:00 as previously promised. Eventually we departed at 17:25, more than nineteen hours after the original scheduled departure time and more than three hours after the revised departure time.
    How should I claim for compensation to give me the best chance of success?...
    1. On the basis of a Cancelled flight? - The Gatwick arrivals board, in the early hours of 2nd June, showed the flight as Cancelled. Also the FlightAware flight tracking website shows it as Cancelled. Since we eventually travelled on the same plane but the next day and under a different flight number I feel that it was Cancelled rather than Delayed. My worry is that EasyJet will throw out my claim by saying it was not a Cancelled flight or by claiming that the technical fault was “extraordinary”.
    2. As a Delayed flight based on the original scheduled departure which made the delay 19+ hours. This way I suspect that EasyJet will still try to wriggle out of it by saying the technical fault was “extraordinary”.
    3. As a Delayed flight based on the revised departure time of 14:00 which means we were still delayed more than 3 hours. In this case I think that the delay was unquestionably under EasyJet's control (thus their “fault”) because they chose to not fly out a replacement plane but sent a replacement component for repair of the original plane.
    Whaddya think?

    This flight was delayed by 19 hours. (You can't simply reschedule on the eve of departure, otherwise no flight would ever be late!)

    I am sure EJ will claim that the delay was "extraordinary" - but they would be wrong, wouldn't they?
  • Hi all, I've been trying to get Easyjet to pay due compensation for several years now, after a 9 hour delay. They still use the 'extraordinary circumstances' excuse (technical difficulties) I would now like to take this to court, but wish to know if anyone else has tried this yet with Easyjet??

    Folks apologies if I've posted in wrong forum. Stepped off cruise yesterday (Saturday 6th September) to find out my Easyjet flight from Venice to Paris had been cancelled at last minute due to Italian air strike. Email offered refund or transfer to another flight. Nothing on email about accommodation for stranded passengers etc. Spent 40 minutes trying to phone Easyjet without success at considerable cost to myself. Had non refundable hotel accommodation booked for 2 nights in Paris plus return flight home from Paris to Dublin with a different airline was clashing with earliest available date of replacement flight from Venice to Paris on Tuesday 8th September.

    So as to not lose return flights home from Paris to Dublin paid for 14 hour overnight train from Venice to Paris at cost of €270 for both of us. Train journey was awful. Shared cabin with 4 strangers crammed in like sardines. Insect bites from journey. Lost 1 night's hotel accommodation in Paris too.

    Before I accept refund from Easyjet want to know if under EC261/2004 I can get them to cover our alternative arrangements for rail travel expenses for journey from Venice to Paris plus 1 night's hotel accommodation we lost in Paris? It would have cost Easyjet a lot more had I waited on the earliest flight opportunity. If Easyjet don't reimburse me begrudge having to pay a travel insurance excess.

    You may have a valid claim since the ATC strike finished at 3.30pm on Sat 6th, not having an available flight for you until Tuesday 8th is unreasonable. There are 2 hurdles for airline to avoid paying the compensation, one is being able to use EC, the other is the reasonable measures upto intolerable sacrifice to provide alternative flight. I and hopefully a judge too, would probably consider a 72 hour delay unreasonable.

  • I would expect Easyjet to compensate me as their earliest alternative flight 3 days later from Venice to Paris would have meant me missing my return flight home from Paris to Dublin. In the meantime do I accept a refund? Would it jeopardise any further legal action?
