That is only my legally untrained opinion. Others maybe able answer more definitley.
I'm not a lawyer, and nor is 111KAB - but in posts 784 and 785 we suggested a test to establish the status of the charter, and asked for a bit more info from Scooby. Hard to be more definitive without that, I think.0 -

Recently our Jet2 flight from Dalaman back to Glasgow was delayed for 22 hours. No announcement was made until 5 minutes before our original departure time. Communication was non existent & nobody was able/willing to give us a reason for the delay telling us they would give us more information at 12 noon the next day (13 hours later). Strangely, the Jet2 Bordrum/Glasgow flight due to leave round about the same time as ours was also delayed by 20 hours (both flights left Glasgow for the outbound journey more or less on time) & I have suspicions that these are linked - it seems too much of a coincidence otherwise.
We were finally told at 3.00pm the next day that the delay was due to a technical fault on the outbound journey resulting in the plane turning back and landing in Birmingham.
I submitted my initial claim for compensation & have received their response stating: "Our investigation shows extrodinary circumstances led to the delay of your flight. Compensation for delays caused by extrodinary circumstances are excluded under Regulation 261/2004. More specifically the delay was caused by an unexpected flight safety shortcoming . Consequently there is no entitlement to compensation on this ocassion"
Do Jet2 need to provide evidence of the safety shortcoming & would it be worth my while asking them to reopen my claim & provide the evidence or should I escalate to CAA? Thanks0 -

I'm a bit confused and hope someone can help. I had a 252min delay from Palma to Edinburgh in September 2011 and have written to jet2. They say they won't deal with it as it two years ago. I thought the law said six years? How do I proceed now since the flight originated in Spain, do I need to complain in Spain? If so can I do it in English?
I am quite clearly just being fobbed off by them!

Read thread (plus make reference to Thomson thread) as the 2 year rule is a load of ...... Forget Spain - a waste of time really - it is not the Spanish but the ability of Jet2 not to recognise what Spanish NEB tell them is correct.0 -

Hi -The Flight number was LS765 Outbound from Manchester To Funchal (Madeira) On 06/08/2012. Flight was subchartered by Strategic Airlines with subsequent delays of 6 hours due to Strategic recalling their plane to recover their own flight programme. Strategic now not in business but surely Jet2 should honour my claim and not keep reiterating extraordinary circumstance?0 -

I was on this flight too and have been in communication with Jet 2. Their latest response suggests that the technical fault and 'extraordinary circumstance' was due to an issue with an electric hydraullic pump. Whether this excludes them from paying out or not I don't know but they certainly made no effort to send us another plane/reduce our delay (as you know) so I think I'm going to report it to the CAA!0 -
