    Here is what the EU themselves say .....

    The document published is a preliminary non-exhaustive and non-binding list of extraordinary circumstances resulting from the work of the National Enforcement Bodies (NEB) for the application of the current Regulation (EC) 261/2004 as discussed during the NEB meeting on 12 April where 24 EU NEB plus Iceland, Norway, Switzerland were present and all NEBs had the opportunity to send their comments and/or agreement by e-mail. The Commission services have decided to publish it, even in its preliminary stage, as a response to the insistence of the majority of NEBs. Only NEBs took part to this exercise.
    The Commission made sure that on the first page of this document its nature and origin are clearly stated.

    NEBs agreed also that this list should not be considered binding and that each case would still have to be considered on its individual merits, but that the list could assist them in enforcing the Regulation on a consistent basis. In this sense, the first page of this document is self-explanatory.

    Well it seems you are frightened of them and if you do not understand or cannot get to grips with the law (having read this thread I presume) you are probably best to place the claim in the hands of a no win no fee firm. :)

    You need to do your own research Kimberley. And it DOES sound like you are frightened of the airlines and willing to believe the nonsense they spout. Maybe less hassle if you walked away?

    I think that's a fair point Vauban. When I started my claim, I thought it would be an easy thing to do, but I guess for many it's simply too much hassle, that of course is what Jet2 are hoping you will think.

    It started like too much hassle for me too, but honestly if you read up on all of this thread and do your own research it's surprising how exciting it can be, I found out today that the plane we flew on was 26 years old and Jet2 bought it from China!!

    Eventually win or lose, I will have enjoyed the research and the knowledge I have gained, just issued a Practice Direction 18 request today, well chuffed with myself :-)

    I've enjoyed my voyage of discovery immensely too - my wife would say too much. I have read up on so much background, including legal, technical and policy issues, and found it fascinating. I am actually looking forward to court in a couple of weeks time.

    But it does require commitment, and if folk ask easy questions that have been answered here many, many times before, I don't think it is unfair to question whether they are cut out for the road ahead.

    I can assure you I am in no way frightened of them. Having been through a 2 year court case that ended up being heard for a week in the High Court in London nothing frightens me now. Nor am I naive, it may well be that the airlines lack a certain degree of candour but I'm not sure that you can dismiss their letters to me as nonsense, that would be up to a court to decide. If my easy questions irritated you I can only apologise, it was my understanding that forums were a place where folk could ask for help.

    It has become apparent though that this is not necessarily a simple process and would require a lot of time and research into a field that I have no knowledge of. I'm happy for you that you have enjoyed the process but I simply do not have that time. My time is better spent on other matters and so I am content to hand it over to a professional who might be able to win compensation on my behalf. There is no shame in that! You're right, I can do without the hassle and at the end of the day I hadn't even considered compensation 18 months ago. It was purely due to reading about the new regulations in the press that I thought I might as well try and I have already been successful with one claim, which only took 6 weeks and 2 emails. Anything I receive now for my remaining claim would be a bonus.

    Thanks to 111KAB for giving me the name of a firm who specialise in this, I have submitted a claim.

    Many thanks too to everyone who took the time to post information and links to assist me, it is very much appreciated.

    I hope that my posts which include the content of the correspondence I have received from Jet2 might help others who are submitting claims. Good luck everyone! :)

    KA we wish you success in your endevours. Indeed there is no shame in a NWNF, I don't think any was suggested.
    Regular contributors do have an issue with the many people who ask pointless questions that have been answered many, many times over. It does take some reading to find the answers but that is small beer compared to the work required for due legal process and some posters would appear have neither the time, inclination or where with all to go forward on their own.
