  • Since issuing with MCOL, it has been quiet until today, Jet2 defence has finally landed on the doorstep.

Previous post with details of claim can be found here: https://forums.moneysavingexpert.com/discussion/comment/62681338#Comment_62681338

If anyone has any specific help I would be most grateful.

First thing they quote is the familiar ‘locus standi’. To this well I made the booking, using my debit card, and also quoting their own T&C’s previously posted on here saying that I’m the lead name on the booking etc, etc….

They then quote the ‘extraordinary circumstances’ list published on the 22 July 2013 by the EC. Then go into the particular problem with my flight. Namely, that the No6 brake unit had begun to, or may have begun to, disintegrate internally.

They go on to say the brake unit had been checked on the morning of the flight and no defect had been reported.

Their final point is that the favourable AESA report is not relevant/ to and/or admissible, mainly because Jet2 failed to give AESA the information that they requested.

So I have to decide to either give up or fight on in Court.

Any advice would be greatly appreciated.

    Kind regards,

    NoviceAngel

  • I tried to claim compensation for my return flight from palma to newcastle with Jet2 after being delayed by over 4hrs. They claimed it was extraordinary circumstances, which it wasn't. The front tyre was punctured as we were reversing away from the airport, which may be extraordinary, but the delay was caused by the airline not having a replacement tyre on Majorca and it having to be flown in from somewhere else in Spain!

    I'd like help with.....
    a. Should I go back to Jet 2 and explain this?
    or
    b. Go to step 2 and complain to CAA? Would it be CAA I'd complain to or someone else since the flight I'm complaining about didn't depart form the UK?

Not sure what to do next .Help please.

    Hi Primrose,

    In answer

    a. don't go back to Jet2 you're wasting your time, gust give them 28/14 days notice of your intention to issue via MCOL.

b You would complain to the member state air authority in your case the AESA.

Go back to page 1 on this thread and all the info is here and worth the read.

And plenty of peeps on here with relevant experience.
Jet2 will most likely take it all the way to court.

Read the thread "Taking the airlines to court" - there are some useful links there.
