    I decided to go down this route & sent all my docs off to B*TT & Co, (3 letters from Jet 2 & my replies etc) and they are telling me they cannot proceed without my original boarding cards & email confirmation. I had all flight information & Jet2 were happy (!) that what I had proved I was on the flight (still in my flight history as I WAS a regular flier with them) so what to do now, any advice? Don't have boarding cards or original flight confirmation as it happened 2010.

    Ask them why?
    And then ask them if they have heard of SAR?

    It seems to me that a lot of these NWNF firms are now cherry picking the easy money cases.

    I would imagine the reason is that, although you sent to Bott & Co your previous correspondence with Jet 2 (confirming you were on the flight), Bott & Co would have to start the claim "afresh"

    In effect starting the claim from scratch, to ensure all the i's were dotted and t's were crossed.

    Not a case of cherry picking, i suspect, just a case of Jet 2, now adding more hoops to jump through when pursuing a claim.

    First of all trying the old 2 years for a claim trick , then the boarding cards trick, finally getting to the old "flight safety shortcommings letter" etc. etc.

    At each stage people will fall by the wayside.

    Even so, Bott and Co should be wise to this and be able to actually find out off Jet 2 if someone was on a flight by some sort of data request or something ?!

    Ive sent you a pm.But your solicitor doesnt actually need the email or boarding cards thats more an EU directive whom they initially work with.

  • Thanks for everyone's advice, & the PM, I have spoken to the solicitors & they have been more than helpful, they will ask the EU claim people to transfer the claim directly to them. Unfortunately they have to commence the whole saga again with Jet 2 & give them 30 days to respond, but hopefully, fingers crossed, someone will have had a break through by then & all the rest of us will have an easier time.
  • Does anyone know how to get details of the movements of a plane over a period of a few days?

    Jet2 are stonewalling me over this. Court date is late August.

    My delay resulted from the fuel problem at Manchester last year - if I can provide evidence that Jet2 flew the plane into Manchester after the fuel issue had come to light without enough fuel to get back out (i.e saving money flying with just enough fuel) - then I reckon I have them over a barrel..

    I know the model of the plane as they gave me the reg. number so I know the documented range (fully loaded)...

    They are also claiming an unexpected and therefore extraordinary technical fault (an unspecified engine sensor failed well below usual time period) after they diverted the plane to to Donnie to re-fuel but I would ask the judge to disregard that evidence since , if Jet2 had catered for the fuel shortage properly - they cannot prove the sensor would have failed had the plane left on time....

    And anyway - seeing as how the plane is nearly 25 years old , I would have thought parts going wrong would be well expected and not extraordinary at all...

    And yes - I hope they are reading this...!

    when you say they are stonewalling you what do you mean exactly?
    If you ask their defence ie 2 birds a list of questions you would like answering before the 14 day service into court and copy to yourself then they have 2 choices.They either answer those questions such as the plane movements pertinant to the fuel shortage or they argue in court why they think its not relevant to provide those answers.the judge will draw his own conclusions.
    Ive asked lots of questions such as why they dont carry spare parts or have local agreements to source them immediately when needed?
    Why they dont have stand by planes given the fact they have an appalling delay record ?
    You can ask anyone anything and its up to the judge if he sees fit to expect an answer.
    ask away and make them research and provide you with everything you think you have the right to an answer.
    When I sent for further answers to 2birds their email was on the lines of "all your points will be dealt with in our defence into court."
    so that suggests i will get a whole spiel of crap 14 days before.
    Good luck with that I say!!
    And also it is worth pointing out that although jet2 planes are up to 5 times the age of their rival airlines they will provide details of the reliability of these aged planes in comparison to newer models.
    Its more the issue that they are run on a shoestring and always in service so worked to extreme.
    after all if they werent always in service then they would be available as standby planes for all these technical problems that do and will occur on planes which are not and never will be extraordinary circumstances.

    And the bottom line is that a 20 year old plane could have 20 year old components, if they haven't been replaced. No part last forever, moving, spinning, solid state or otherwise.

    Has anybody got any information concerning Jet2 flight LS810 scheduled to leave Malaga airport(AGP) on Sunday evening (about 20.00 approx. from memory) the 1st November 2009 to Manchester (MAN) which suffered a 5 hour and 23 minute flight delay which resulted in a return to Manchester in the early hours of Monday morning the 2nd November 2009 which landed at 03.28
    Any information gratefully received, contact me by private email using this forum if you wish.
