Do not despair people. Delighted to announce that the District Judge today found in my favour despite the best efforts of Jet2's barrister and two witnesses.

Hi all,
I'm new to the forum but also have a claim for a delayed flight currently going through the small claims process in Scotland. Again Jet 2 are arguing that a technical fault amounts to extraordinary circumstances. They have listed two witnesses, {Personal details removed by MSE Forum Team}. I get the impression that neither of them were in any way involved with my particular flight but are simply now going round giving evidence in all of these cases. Can anyone else who has had a case confirm if these are the same two witnesses mentioned elsewhere?

{Personal details removed by MSE Forum Team} gave the "engineering" evidence in my case and spent much time showing how the faulty bit in my case worked. He couldn't say why it failed and suggested that it was a random failure which could not have been anticipated. Nothing contentious there. The other witness in my case was {Personal details removed by MSE Forum Team} who is an operations man and I would assume {Personal details removed by MSE Forum Team} will be also.
Stick to the argument that it is inherent in the normal activity of the air carrier and their evidence is pretty much irrelevant. See also post#172 in the Court Success thread0 -

We were on a Jet2 flight from Italy to the UK which was delayed by 4+ hours due to a technical failure. Having read in detail all the very useful posts on this forum and anticipating that a successful claim from Jet2 was going to take a huge amount of time & effort, I opted to submit my claim to EUClaim to handle. They stated clearly from the outset that the process had a zero financial risk to me (i.e. if unsuccessful EUClaim / B*tt & Co would pay all fees *and* disbursements (e.g. expenses / court fees etc.). The fee if I win is 27% of the compensation plus 25 Euros per passenger, which I felt was reasonable.
All was going well until I received the B*tt & Co T&Cs / Conditional Fee Agreement to sign. This states:
- If you lose you do not pay our charges but you may be required to pay our disbursements.
- If you win your claim, you pay us an administration fee and our charges. You will pay disbursements in any event and on our request and the payment of disbursements is not conditional on success and is not deferred to the end of the case
- We can end this agreement if we believe you are unlikely to win. If this happens you will only have to pay our disbursements.
etc.
- This agreement is a binding legal contract between you and your Solicitor, B*tt & Company. Before you sign please read everything carefully.
I have spoken to B*tt & Co who have said this is just 'standard T&Cs' and they can't change them and have sent an e-mail saying 'You can therefore be rest assured that you will have no costs liability should you lose'.
I am naturally a little nervous about signing a legal document that appears to leave me open to paying disbursements (which could, in theory at least, include barrister's fees). Am I worrying unnecessarily? I would really appreciate some advice from people more knowledgeable than myself.

I was also in the same boat & very worried about the small print, so much so I rang B*tt & Co & was very reassured by speaking to 1 of the aviation team (for a good 20 minutes or so - very informative!), apparently the wording is as such because airlines were contacting clients direct & settling - so this is to protect their agreed fee.0
