  • Dear all this is my first posting. I have just won my clam from Thomas Cook on the delay flights bug they have offed this in vouchers. Dose any one know if you have to accept vouchers.

    Should be on TC thread - but no they should pay in cash and indeed only send vouchers with your approval - tell them to stick their vouchers where the sun doesn't shine and transfer the money immediately to your account.

    If the reason for a delay is actually a known manufacturing defect that dates from before the flight and you have found EASA documentation to support that, and that documentation says the manufacturer contacted operators about the issue, a Mandatory Occurrence Report MOR (or equivalent) will have been sent to the operator - is that fair assumption?

    Can one ask the court to force the airline to produce any such documentation that they have in their possession to the court?

    J2 seem to be finally coming to their senses so I doubt you'll get to court, but the very best of luck if you do.

    It also seems that J2 are attempting to gag claimants when they concede cases so be prepared.

    Indeed that seems to be the case, but they aren't doing a very convincing job of it ;)

    To other J2 passengers, if you do receive a settlement and wish it to remain private then you can always PM one of the regulars in here, and we'll share the news without linking to your forum username.

    It seems that they are settling a small number of claims, although strangely still fighting others...

    You can certainly ask the airline to produce any material that they have in the case, I asked for detailed maintenance reports of the brake unit that had failed. I did this and issued a practise direction 18 request the airline responded with it's too time consuming and this is only a small case claim. A refusal to co-operate could look suspicious to the DJ.

    Yes I believe so.

    I feel your main obstacle will be the 2 year T's & C's so keep a close eye on Figh2Survive2013 court case on 24th March, perhaps you could even pool resources and knowledge before then.

    I thought that they might be settling cases where the 2 year time bar, is not an issue but then there's DrA s case......

    ....... My prediction is that he's going to get an offer very soon.
