    Just heard of some really distasteful behaviour by Jet2........

    In their defence.............

    12 b Further to any Court ruling if the Claimants claim is not time barred, any compensation due to the applicant would immediately be recoverable by the Defendant as damages for the Claimant's breach of their contract,.not to bring proceedings more than two years after the said flight. We will seek damages for our client.

    Wording changed slightly to protect the LiP, but you get the gist of what that means!!!

    Wow! That really is something! But I suspect it's designed entirely to intimidate a litigant in person rather than having any real basis in law.

    It's a tenet of our legal system that you can't re-litigate for something you already lost. So if Jet2 try to argue that the contract makes no provision for a 261/04 claim after two years, and a judge rejects this argument, they cannot reasonably go on to sue for breach of contract.

    I hope they come up against someone who issues a counter-claim for such disgraceful behaviour ...

    The above is an absolute abuse of the Court Judicial process, DO NOT be scared of their disgraceful bully boy antics, it is my opinion that any DJ would laugh this one right out of the courtroom..

    Indeed, I myself was threatened with an Order for costs if I refused to agree a stay pre-Huzar ruling, I didn't agree to a stay and told them this was a small Court case and in my opinion they would not be granted any such costs order, nothing came of it, but boy do they try.......

    Unfortunately, while airlines such as Thomson have now accepted defeat and are doing all they can to clear the backlog of valid claims, Jet2 are doing all that they can to avoid paying under the regulations. The answer is not to be put off by these tactics and to press on.

    Yeah, I got that one too - sounds like a standard ruse!
