    EU Regulation 261
    Subsequent to a judgment given on 11 June 2014, in which the Court of Appeal held that a technical defect was not in itself an extraordinary circumstance and that compensation for delay may be payable, Jet2.com had its application to the Supreme Court, to appeal the Court of Appeal’s earlier decision, rejected.
    Accordingly, the Consolidated Group Income Statement includes an exceptional provision of £17.0m in relation to possible passenger compensation claims, which may be payable in certain circumstances, for historical flight delays over the past six years


    Howtickled - this was extensively press reported at the time but more importantly their forward exposure to claims - which if everybody claimed - amounted to c. £4m pa or broke down to 50p per person per sector. So Jet2 (who you cannot believe anyway) estimated an absolute top increase of 50p per flight to satisfy every claimant. Given that flight prices have effectively fallen by £5 per sector due to fuel price decreases added to the strong £ and Jet2 are 'doing alright' or at least Dart are. As far as I am aware all airlines treat 261/2004 as a self insurance issue.

    I have now written back to Jet2 saying that their letter gives no evidence of such extraordinary circumstances and given that they even got the flight details wrong can their judgement even be trusted.
    ' Please now provide a full and detailed explanation of the extraordinary circumstances that caused the delay to this flight so that I may pass these onto the CAA for their interpretation. You can not unilaterally classify a delay as such without a full and detailed explanation so others can also judge. Please provide this evidence within 14 days'

    I'll report back on the reply I get.







    I was on the same flight ..... did you have any success with your claim??? I have been told the same from Jet 2.

    I was more surprised that they seem to be admitting in their report that techhnical defects are not in themselves exceptional circumstances and that claims can go back six years.

    Yorky has not been on the site for almost a year so we don't know how it all ended.... if it has!

    You almost certainly have a valid claim but would need to pursue it further yourself.

    Around that period in time Jet2 would often bus passengers over the pennines so that the aircraft was positioned at the right airport for the next flight. There is a very good chance that you aircraft operated it's next flight from Manchester.

    The excuses that they gave to yorky were their usual bunkum.

    When they suggested a letter to the CAA they were just buying more time, don't fall for that one! Do it yourself, with our help if necessary, or go NWNF solicitor who will happily take it on at a cost.

    I suspect the £17.0m put to one side for passenger compensation claims is NOT to pay passengers BUT to continue funding 2 birds.

    August 7th 2012 ......If you were delayed due to pressurisation problems on this Jet2 flight it appears (according to official report) that maintenance was not carried out as required so you will be entitled to compensation > http://avherald.com/h?article=454b6fc2&opt=0

    Indeed, poor maintenance and an ageing fleet do not bode well for flight delays or flight safety.
