    I wouldn't say he was hopeless. It was a fair fight, in as much as 2 "expert" witnesses and a senior legal representative (he didn't actually introduce himself) from deux oiseaux, against an LIP ever can be. ( I believe this is still one of the MAJOR faults of the SCC process).
    He just made completely the wrong legal decision.

    They won't do anything until you start a case against them. You can argue the terms are unfairly restrictive (which they are) but it's a technical argument which has been discussed earlier in this thread. They'll also ask to stay pending the Van der lans case, but if you wait until Feb 25 that should be cleared up by a "test" case in Liverpool. Similarly the 2 year time-bar should be cleared up by another case in March (17th I think). I don't have the details of that case but I'm sure someone on here does. So my advice would be to watch this space and wait until those are over and then start action. If you go to a NWNF, use Bott, but they will probably advise the same.

    If by any chance you would be claiming via the Scottish Court System pour a cuppa and have a read at this case on the link below where two Sheriff Principal's, at appeal level, kicked out the 2 year limitation nonsense.

    Interesting reading len, alas the crux this appeal relates solely to the difference between damages and compensation. The appeal was sucessful only because of this point.
    Ryanair have subsequently changed their wording (which as the Sheriff pointed out was an admission in itself!).

    But Jet2 have done the same, they have now added the word compensation to their TCs.

    Accordingly, the Consolidated Group Income Statement includes an exceptional provision of £17.0m in relation to possible passenger compensation claims, which may be payable in certain circumstances, for historical flight delays over the past six years
