  • Hi all! I sent a letter off last year re flight from Faro to Glasgow delayed for over 10hrs travelling with my partner, two kids ages 1 and 4. The usual response was received - out with the 2 yrs (I travelled August 2011). Used the template then looked at the forum and could see how it was going. Patiently waited til last week and sent second letter off with all details from before including booking sheet, details of flights and passengers. Received a letter today telling me they will deal with my letter in date order but confirm receipt. And that as they can only take the claim from each individual (disregarding I am noted as lead passenger and booked it all) they will only deal with the claim for me and not my partner or my 5 and 7 yr old boys!!! How low are they actually going to stoop for delay tactics eh? Looks like it's court then........

    Hi Dunin,

    Welcome to the forum and thanks for posting in the right thread.

    My advice would be to issue an NBA letter, and then after a 14 day wait commence proceedings in the small claims court, you are the lead passenger, you made the booking and I trust you also paid with your debit/credit card for your party, there has never been a definitive answer to how to claim for a group, but you certainly do not need to make individual claims, you might however, be wise to issue proceedings via paper (add additional claimants)rather than MCOL (single claimant)- just to get things 100% correct, this seems to be the consensus on here.

    It makes me smile thinking that they have the audacity to send letters out saying that they will deal with claims in date order, they are not even dealing with current 'stayed' cases such as my own!

    I think it's highly unlikely that your claim will be dealt with in any way without sadly, taking legal action.

    If you don't fancy taking legal action yourself, then you can employ a good NWNF solicitor, such as Bott & Co - others available - they take I think around 30% of any successful claim. I haven't used them myself, but they famously represented Mr Huzar in a landmark case.

    Thank you for the welcome, reply and guidance - very much appreciated. I have been following the Huzar case but I will have a look back at Vaubans guide as you advised.

    I didn't expect them to roll over and pay up to be honest but I did smile at Jet2's audacity myself today when I read the ridiculous response. Yes, indeed, all booked and paid for in my name and card and it's clearly stated as such in both letters. To even write that letter knowing that the children couldn't claim for themselves was obviously another ploy to put me back a few years more!

    I will send the template letter as you suggest and then look at the solicitor route. I hope that your case is dealt with and paid out on quickly. Again, thanks for taking the time to reply to me :))

  • I hope it will amuse fellow sufferers. Whilst digesting Jet2's latest trickery I remembered a time long ago when we had suffered a different 24 hour delay at their behest. So I dived into the archives....


    How long? Check fotos... 5 years 10 months!
    Flight number? Can't remember.. read forum advice.. check FlightStats.. Good Lord there it is..


    Can I face the long haul of having another pop? You bet!

    You are right, but I have given them 14 days to settle and pay up or I will start court process. In view of their actions in relation to those already in the court system, I expect I will need to join the back of a long queue!

    Since your already dealing with 2 birds directly on your other case, I'd copy the NBA directly to them, at least they know it's not an empty threat.

    You never know we all might get cheques just in time for Xmas :j


    EDIT - I came back to this because despite my levity above, I'm sure (by reading your other posts) that you would have settled in the first instance with a goodwill gesture of a discount towards a further flight, that's the true sadness of all this, nobody wanted a fight, but Jet2s deplorable behaviour in this matter has caused untold damage not just to their reputation, their share price and reflects badly for the area that we both live in.... I just don't think I'll ever be able to begin to comprehend their attitude in all this!

    Allegedly, it is thought by academics, that those in powerful business positions, statistically, have much higher psychopathic tendancies than the norm. And before anybody gets arsey here is a definition of a psychopath:
    "A person with an antisocial personality disorder, manifested in potentially aggressive, or amoral behavior without empathy or remorse."
    I'd say that pretty much sums up the attitude of quite a few airlines in regards to 261/2004, don't you?

    But the advantage of starting a court action is that it a) concentrates the airline's mind and makes them take you seriously; and b) if they are still messing you about, you've started a separate process which ultimately the airline doesn't get to determine. Starting a court case in and of itself isn't quick, but given the ample evidence of many airlines' refusal to take legitimate claims seriously, it's still the right thing to do if you've given them an opportunity to settle and they've brushed you off.
