Correct but the time limit to take it to court it determined by which country in the EU you are. In Scotland this is 5 years, in England and Wales this is 6 years
You can make your claim and the airline knows that they can reject the claim or ignore you and what can you do about it if it is over 6 years....absolutely nothing (I have not seen any reports of any airlines paying out for delays over the court cutoff limit)
This is all covered in the FAQs
Ahh, no problem, thanks goes clearing it up!Albert Einstein “Imagination is more important than knowledge”0 -
Hi all! I sent a letter off last year re flight from Faro to Glasgow delayed for over 10hrs travelling with my partner, two kids ages 1 and 4. The usual response was received - out with the 2 yrs (I travelled August 2011). Used the template then looked at the forum and could see how it was going. Patiently waited til last week and sent second letter off with all details from before including booking sheet, details of flights and passengers. Received a letter today telling me they will deal with my letter in date order but confirm receipt. And that as they can only take the claim from each individual (disregarding I am noted as lead passenger and booked it all) they will only deal with the claim for me and not my partner or my 5 and 7 yr old boys!!! How low are they actually going to stoop for delay tactics eh? Looks like it's court then........
Had a similar letter today. Given that they would only deal with the lead passenger before and that I'm claiming for 13 people, I think it's now time to go no-win-no-fee.
Their latest letter was in response to a 'chase' letter I sent after the Supreme Court ruling. The last letter I had from Jet2 was dated January saying they'd be in touch in due course.
The CAA are about as much use as a chocolate fire guard, only saying I have to refer the matter back to the airline.
Another tactic of Jet2 is to disregard 2 requests to change my correspondence address as I have moved since the initial claim letter. However, my post is still being redirected.0 -
, I think it's now time to go no-win-no-fee.
.
If you don't have the confidence to follow Vaubans excellent guide, then yeah no harm in using a good NWNF Solicitor, they take around 30% of your 'unexpected benefit' to quote from JET2.
I'd have a look at the solicitors that famously represented Mr Huzar, they are mentioned all over the Huzar thread and good luck! After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

It does seem a bit barking. But reading between the lines your judge seems to be saying: "Dr. A has a slam dunk case now - can you give me any reason why I shouldn't order you to pay out in full?" If they present that !!!! about Holland and whatever I hope it receives a sufficiently bluff Yorkshire rebuff!0 -

Yes, I recall it's quite a long time ago, I think jet2 wil have to submit the Amsterdam case rubbish, like they have done in the other cases, this might just be the first case where a Judge considers their latest reasons for cases to remain stayed.
Good luck, you should get a copy from 2birds of any court submissions they make in your case. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

So Jet2 have had their 14 days to respond as i stated in the nba letter that i sent them. All i have received back is a generic letter saying that they had received my letter and are dealing with all claims in date order....blah blah. Next stop is court, can i use the mcol service or do i have to send a paper claims form? The claim is for myself, my partner and daughter( i booked and paid for all three flights).0

Given Jet2's attitude to claims I would go N1 (paper) as they will look for ANY excuse not to consider.0 -

You forgot (probably because they are not paying out!) the friendly, caring Monarch - their letter seems the most threatening of them all .... if you go or think of going to court we will go running to the judge and say we were dealing with your claim.0
