  • Hi everyone
I'm not filled with positivity after reading the last few pages of posts, however I'm putting a claim in to Jet2. In September 2012 I was due to fly from EMA to Corfu at 8am but the flight was cancelled as the plane was "stuck in Corfu" and we were coached up to Leeds for an afternoon flight - as it happens we didn't reach our destination of Paxos until 2 days later because storms hit Corfu in the evening, so for us it was a double whammy!
I emailed the address that the MSE FAQ linked me to however I did not receive an acknowledgement or reply after 21 days so I emailed again, they have now replied telling me to put my claim in writing to a different address than that listed on their main web site.
I'll be interested to see if I get an "no due to extraordinary circs" becuase back in 2012 I complained to the holiday operator about the overall delay and they wrote back with an explanation and blaming Jet2.
I wont hold my breath and to be honest if I get no joy in a few months I'll probably pass on to a claims Co because I've already had months of to-ing & fro-ing with Olympic Holidays.

Their third reply tells me that the actual cause was down to a "faulty anti ice valve" on our aircraft. Basically they are telling me that this type of incident is fortified by the NEB's working group. They quote several paragraphs (24,25 and 26) of the NEB list and provide web addresses for me to check for myself. They reiterate that a faulty anti ice valve falls within the NEB definition of "extraordinary circumstances". They go on to say " we firmly believe that, as in over 90% of claims that have reached trial to date, the court will agree that Jet2 could not have avoided the delay even if all reasonable measures were taken".
Has anyone been a faulty anti ice valve victim and does this, as they say, only have a 10% chance of success?
Is it time to put this in the hands of a claims company?

I think they copied and pasted this from one of their letters to me (November 2013) - I've had exactly the same response from Jet2, but in my case about a faulty VHF control panel for our flight to Faro in August 2012, quoting the NEB list, 90% of claims etc.. Time to go to court, as I will now need to do.

So, I decided to go along the NWNF road. Put in details of flight and date on the Bott website. Result:- "We can't handle this claim because it was "extraordinary circumstances". That's what Jet2 told me. I thought the whole point of using Bott was because we were getting that excuse from Jet2. Just what cases will Bott accept?

Looks like claimants (and possibly advice given) can't be right all the time.

NWNF solicitors will not take cases on that they fell they will not win or they may have already tried and failed with this one

For what it's worth, I'm quite surprised at that. From what you have said on the forum, it looks to me like a fairly standard "technical issue". An "anti ice valve" is no doubt an important component - but aren't they all on an aircraft?

Perhaps contact Bott with your observations and see if they add anything to the knowledge of the circumstances.

On the Bott & Co, site a 'chat box' popped up and I had a short live discussion with one of their call handlers (Kavita?). Asked me for full details again and she/he agreed to investigate further and would get back to me this week. Fingers crossed!

Received e-mail from Kavita at Bott & Co. today. She tells me that EUClaim who supply all their flight information have told Bott that the flight was 'banned' (Kavita's words) because of 'hard' winds at Manchester Airport!!
Complete nonsense! Other flights to Manchester were leaving all the time. If this were true, surely Jet2 would have used this cast iron defence against my claim. Jet2 themselves tell me that it was a delay caused by an anti ice valve and the fact that the replacement aircraft had to complete it's normal schedules before it could get to Faro.
The relatives who met us at Manchester confirm it hadn't been a windy day. Who are EUClaim and is it possible for them to have keyed in the wrong date or something?

All possibilities exist. You coud check with Manchester airport on the weather conditions at the time.
Unfortunately, not all aircraft are created equal, some are able to land with stong crosswinds/shear etc, some can't, depending on the aircraft type/model load etc. HOWEVER, jet2 mainly operate 737/757s most of which have the relevnt specs for strong winds, since their HQ is Leeds/Bradford which being one of the highest and most exposed tends to suffer from said crosswinds frequently.
It may take legal action to flush out the truth, and Jet2 will procrastinate and fight all the way.

Does anyone have any recommendations which firm to go for if we go down the NWNF route?

I have 3 delayed flight claims and all came up as claimable on the Bott website. Are they a good bet?
