    Just to confirm, this is Centipede100's template letter?

    24th May 2010 our flight from Manchester - Murcia was delayed around 3 hours. We were actually boarded onto the plane at some point but made to sit and wait for hours on the runway prior to departure! Jet2 stated at the time that this was due to the restrictions of Murcia airports arrival schedule (being a military airport) and that we couldn't risk losing our new slot due to boarding delay? I was 6 months pregnant at the time, so you can understand our disbelief!

    I have checked on flightstats and the arrival time is not stated, and it has the status as unknown.

    Was anyone on this flight? Or what can I do to find out if we landed 3 hours late?

    given that the departure time was showing as 2 hours 39 mins it is probably unlikely that they would have lost further time taking it to over 3 hours. However if by chance it was I would expect them to call out the restrictions as being out of their control and therefore no compensation due

    Just got an update from Bott on my case:

    We have conduct of the highest authority court case in the UK around EU Regulation 261/2004 called Huzar v Jet2. The Judge ruled in our favour in this case and confirmed technical defects could not be considered extraordinary and a copy of the judgment can be found at http://www.bottonline.co.uk/articles/approved-judgement-huzar-v-jet2 .

    We have won both these two cases already and the airlines are now appealing the decisions, which means your claim is also delayed until the appeals have been heard and a final Judgement is made. We are working incredibly hard with some of the best Barristers and legal teams in the country to make sure the appeals are rejected and our original wins are upheld.

    Jet2 have formally appealed this judgment and it is likely the matter will now go before the Court of Appeal in 2014, or even 2015 depending on court waiting times. If this does occur it is likely all court cases featuring technical defects will be stayed pending the outcome of this appeal so that there is consistency in all courts.

    Unfortunately your case has been stayed in the interim pending the outcome of these appeals – and this is because the court wants to ensure consistency in the decision making process at courts throughout the country.

    We appreciate this is frustrating, but unfortunately we have no say within the matter. We will of course update you as soon as we are aware of the outcome.

  • We were delayed on this flight for over 12 hours & were transferred to Manchester airport eventually,& flew out from there, they said it was a 'technical fault'. It was actually one of the stairs to the plane had been left without the break on & had skidded sideways into the plane & made a hole in it. Does anyone know if we can claim for this?

    yes you can, have a read of the FAQs etc but don't expect the airline to necessarily pay out easily, read some of the posts in this thread, not sure if anyone had managed to receive payment without having to go to court.
    I have a claim with Jet2 through a nwnf, they ignored them so awaiting the next step

  • I have read this thread for several months now, during which time I have traded several letters with Jet2.com in relation to our flight LS597 from NEWCASTLE TO FARO ON 25TH AUGUST 2012.
    To keep things as brief as possible:
    Departure was delayed because of the failure of the No.1 VHF control panel (an 'on-condition' part as they describe, covered by paragraph's 24 and 25 of EC 261/2004) - we arrived in Faro 3 hours 12 minutes late.
    I first wrote to Jet2.com on 18.02.13, and after receiving their standard 'extraordinary circumstances' reply, I have corresponded with them ever since. They haven't altered their position, but seem to have been able to alter the facts of this case at will, for example:
    1. The No.1 VHF control panel originally had a 'soft-life' of 48,000 flight hours (this is where Jet2.com replace such parts 25% before their Mean Time Before Failure (or MTBF). However, the MTBF for this piece of equipment subsequently reduced to 3,300 hours (it actually failed after 2,880 hours), and more recently I was told it didn't actually have a 'soft-life' at the time of our flight, because if it had, they should have replaced it after just 2,500 hours (it now has a 'soft-life!).
    2. The aircraft was originally declared serviceable at 9.30am, but this was changed to 9.45am
    3. They have suggested that the fault was first discovered when the aircraft was taxiing for take-off, although they changed their minds and have said it was when the aircraft was about to be pushed back, at 7.30am (the scheduled departure time) - they have insisted that passengers had boarded the flight prior to this, but I know this to be incorrect - the first time we set foot on the aircraft was nearer 10.15am. In reality, we spent our time in the departure lounge looking at the 'delayed' message on the board.
    I will at some point need to consider the legal route, but in the meantime, I have asked Jet2.com some more questions about their soft-life information.

    You can't have read all the posts then as playing "correspondence ping pong" will get you absolutely nowhere, if the experience of posters is anything to go by. (I include myself in that, by the way. I did the same when I was young and naive. I'm now old and naive.)

    Softlife, Schmoftlife!! The details of the technical issue are wholly irrelevant. They are bringing all this nonsense out to try and blind you with science (and to try and fit in with the legally non-binding NEB "guidelines") and to drag it out until 25 August this year when they will say you are out of time to bring a court claim.

    Read the Regulation, and read the Wallentin and Huzar judgements. That's the law and the law is the only thing that matters. This is my view:

    Just writing my first letter to jet2 holidays for the flight delay on the 1st feb. manchester to tenerife . 6 hour delay.
    Is there another address to write to other than the customer service department. Or a certain person to address letter to. So to get a quicker response. Thanks.
