I wrote to Jet2 following the TV programme on 17th January 2013 as my flight LS655 on 18th September 2011 was almost 5 hours delayed. Received a decline letter this morning stating they are unable to consider because it occurred more than 2 years ago and that all claims of this nature must be made no later than 2 years from the date of the incident occurring.
When I returned from this holiday (October 2011) I did send them a letter of complaint and they responded with a letter declining the claim but I do not have a copy of the letter nor their reply as I thought there was no point keeping them.
Are Jet2 correct with the 2 year window for making such claims? Where do I go from here - any advice would be very much appreciated.0 -

[FONT=Georgia, serif]After getting the normal response to first letter of extraordinary circumstance, I wrote again asking for an explanation, they have replied with [/FONT]
[FONT=Georgia, serif]The delay was caused by pedal judder and anti-skid issues. These faults occurred prior to departure, constituting an extraordinary circumstance which could not be foreseen, and which was beyond jet2.com's actual control.[/FONT]
[FONT=Georgia, serif]We believe our conclusion is fortified by a recent publication by aworking group of the national enforcement bodies (NEBs) which areresponsible for the enforcement of regulation (EC) 261/2004, of anon-exhaustive list of matters that they consider to be extraordinary circumstances.[/FONT]
[FONT=Georgia, serif]Paragraph 25 of the list confirms that the NEBs consider “failure of necessary or required aircraft systems (for example the cooling system, avionics system, flight control system, flaps, slats,rubbers, thrust reverser, landing gear) either immediately prior to departure or in flight (where those systems have been maintained inaccordance with the required maintenance programme)” constitute extraordinary circumstance.[/FONT]
[FONT=Georgia, serif]This has been published on both the European Commission and Civil Aviation Authority websites[/FONT]
[FONT=Georgia, serif]Aswe have explained, the delay to your flight was caused by brake pedal judder and anti skid issues. We believe that in accordance with paragraph 25 of the NEB list, your delay was caused by extraordinary circumstance. [/FONT]
[FONT=Georgia, serif]We also firmly believe, that as in over 90% of claims that have reached trial to date, the court will agree that jet2.com could not have avoided the delay, even if all reasonable measures were taken. [/FONT]

Harry: Search "NEB list" on the forum and you get just over 100 posts. Take some time out to read these, and you'll understand how these guidelines might affect what you choose to do next. I'm afraid there's no real shortcuts if you plan to take this further.0

also bear in mind that Jet2 want permission to appeal HHJ Platts' decision in the Huzar case, so perhaps wait and see how things happen over the next few weeks.Posts are not advice and must not be relied upon.0 -
I've finally received a reply from the International Aviation Authority regarding my claim against Jet2.com. Apparently my flight was delayed due to unexpected safety problems, "extraordinary circumstances" which could not have been avoided even if all reasonable measures had been taken! The question is do I just accept this answer and give up or do I take it further? I was delayed 8 hours returning to manchester from funchal in june 2011. at the time we were told our plane had broken down and had to wait for a replacement. I don't even know what these "unexpected safety problems" refer to! I'm actually fed up with it all now. i originally claimed back in March 2013!! I'd have just been happy if the airline had refunded my original flight cost. we got a cheese burger, yoghurt and a drink whilst delayed!0

Please be kind to me as i`m a newbie
after having a fantastic few days in Santas Lapland it was marred by being delayed for 6 hours at the tiny airport in Finland Ivalo,I have written to Jet2 but have been told that as the delay wes for extraordinary circumstances more specifically unexpected flight safety shortcoming we are not entitled to any compo-just wondered if any one on this flight have had any better luck?

As the flight was only 7 weeks ago I doubt anyone will have received compensation yet. If you decide you want to pursue a claim, read the FAQs. If you are successful, do come back and post as it may be helpful to others on the flight.0
