  • Has anyone made a successful small claim in the UK Courts against Ryanair? If so, what was the full Company name and address you used?


    I have had a positive determination by the independent adjudicator but they still haven't paid.

    Hi,

    You cannot use the UK court system to sue Ryanair, due to their terms and conditions. It's why UK based NWNF solicitors cannot take them on.

    Who adjudicated in your favour? Ryanair may be committed to accepting their decision.

    Thanks for your quick response.


    I don't intend to use a solicitor to make the Claim.


    I have found the following on the main money saving expert website:


    Booked flights in the UK? You should be able to take your case through the courts in the relevant country you're based in, regardless of where the airline is based.


    Got a UK address for the airline? The European Consumer Centre says if so, you can take an airline to court here, even if the head office is based elsewhere.

    Flight departed or arrived in the UK? The ECJ ruled in a flight cancellations case in 2009 that you can take an airline to court for cancellation claims in either the country the plane was due to arrive in or depart from, regardless of where the airline's based.


    Bearing in mind your advice, is this wrong?


    By the way, it was AviationADR who made the decision back in July but they still haven't paid me.

    Things have moved on since that advice was written.

    Did you accept the decision as required in rule 9 ?(see link to AviationADR rules)

    If you did, you should complain that you did not receive your payment with the 7 days their rules stipulate. It's up to them to get your compensation from the airline.

    I put a claim in to Ryanair for my cancelled flight in July.
    They responded by Email which went into my spam so only just found it.
    They say they won't pay under the EU261 claim because of strike action.
    They do say if I give them my receipts and bank details they will refund reasonable expenses.
    I already sent them receipts for my expenses and claimed in my original claim.
    Obviously if I could get that back it would help, however I don't want to accept the refusal for the flight delay.
    Is there a letter template anywhere for replying to that as the compensation with the ADR needs me to have had a final letter from Ryanair before I can commence my claim.

    Hi,

    The CAA have told Ryanair that own company strikes are not a reason to refuse compensation, so it seems that Ryanair are wrong.

    I believe you either have to wait 8 weeks, get Ryanair to give you a deadlock letter or a referral to be able to pass it on to AviationADR. Either way, that is your best next move.

    If that fails you'll have to use the ESCP procedure, see Dr Watsons great guide for details, Go to post 569 on the Ryanair thread to read how to sue them safely.

    There is no reason why you cannot claim both you costs and compensation separately. You need to tell them they already have you receipts or send them again, to get things moving. If you do, you may as well ask them for a deadlock letter at the same time.

    Hi everyone,
    Yesterday Ryanair cancelled my flight to London, we tried to contact ryanair by phone but they didn’t answer, there wasn’t any rayanair staff at the desk so we didn’t know what to do. The next available flight is on Friday 3rd so we have decided to get the refund and buy 2 tickets with easyjet for tomorrow( £700 ish). Is there any possibility to get any compensation to cover meals, 2 nights hotel(100€ ) and the tickets? I don’t know why the flight was cancelled but when we rang them, the voicemail said there was a strike.

    DON'T go for the refund yet!!
    If you do RA can wash their hands of you with no liability.
    If there is an alternative easyJet flight you are able to recover the costs of the alternative flights from Ryanair, as they have failed to provide you with a convenient re-routing option.
    Is this your return flight home? If so RA are also responsible for your hotel costs and food/non alcoholic drink expenses.
    You may also be able to claim compensation depending on the reason for cancellation.
