Thanks - I did not request, and have not communicated that I accept the refund, so I will mention this in the LBA
I did try AADR, but as the departure and destination was outside of the UK (but inside the EU) they would not proceed the claim.0 -

Could I ask what the opinion of proceding with my claim is please.
Basically I was delayed by 3.5hrs returning from Crete in July. I submitted a clain for compensation on Tuesday however this is the response I have from RA...
"We sincerely regret the delay of your flight XXX from Crete to Manchester which was due to Air Traffic Congestion.
However, as this delay was for safety reasons and therefore outside of RA's control we regret to advise that no monetary compensation is due"
So - is it worth proceding with this??

put your flight details into EUClaim and bottonline and see whether they believe compensation is due0

Thanks, yeah did this with Bott&co and they don't want to know due to the probability of it having to go through Irish courts.I'm still keen on pushing this myself but wasn't sure how much of a fob-off RA's reasons are.0

Hi, I just wondered if anyone has any experience of this:
I have a complaint/case filed with the ADR re a delayed arrival of a Ryanair flight in 2016. I have (after chasing) had notification from the ADR today that they are not accepting any further correspondence from either me or Ryanair and are now considering the claim and evidence.
In the airline response section of the case there’s nothing. No evidence, no documents, no correspondence from Ryanair at all. Is that usual? It seems odd, unlessfor some reason I can’t see what they’ve sent to the ADR but I thought I would be able to.
And, if they’ve seriously submitted nothing, where does that leave my claim...0 -
Sorry everyone, it's still me, still needing advice...
I was determined to take Ryanair to small claims court but, as I've never done it before, I was really looking for some pointers on how to go about the process (see quoted post). Today, due to Ryanair being based in Dublin, my local citizens advice bureau directed me to the UK European Consumer Centre, which would perhaps have been really useful advice when I first contacted them months ago, but appreciated all the same; the Consumer Centre, in turn,
tell me that, under the circumstances, it will be very difficult to make a successful claim; in any case, they suggest I try to approach Aviation ADR for a mediation process.
So what seemed, until today, like a valid claim, has now turned into an unlikely one, and one that the professionals advise I try to resolve by mediation rather than the courts.
I'm happy to be corrected, but I don't see Ryanair taking mediation any more seriously than they took my original claim; but I do think (and my impression from the forum went along the same lines) I have solid reasons to make a claim. Now what? Do I do this via the courts or ADR? Do I have a case or am I imagining it?
Genuinely confused about how to proceed now-- I hate the idea of letting go and ignoring a significant expense I incurred exclusively due to Ryanair's failings; but if the pro view is that it's unlikely to be a successful claim, I'm not sure there's a point in the time and expense of taking them to court.Evening all,

-- I had to book a rerouting flight via another company, the only one available at that time (£350)
-- at some point during my flight ( I only checked my texts upon arrival), the original Ryanair flight was cancelled, meaning that, had I waited for the new departure time, I would have been stranded at the airport until morning
-- upon complaint via the Resolver feature, Ryanair offered (and immediately issued) a refund for my original flight, claiming I "chose not to fly" and therefore had no claim under EU261.

Since small claims court does seem to be the only way of resolving this situation (surreally), I just want to make sure I am exact in my claim.
-- Ryanair issued a €75 refund on my original flight. Whilst this was done without my approval or acceptance, it was issued, so I'd be willing to deduct that from any compensation. Is this a correct/reasonable approach?
-- What compensation do I claim for, though? What I want is a reimbursement for my reroute ticket; would I be able to claim for the delay in addition to that? Or is it more realistic (and fair) to stick to a reimbursement claim?0 -

Ryanair has welcomed a ruling by the commercial court in Barcelona that no compensation should be paid to customers whose flights are cancelled due to strike action.

As it is handed down by the Court of Justice of the European Union it sets a precedent that lower courts should follow, why the Spanish court didn't I'm not sure, perhaps they didn't know about it.
