    @JPears, high costs if I move on from ESCP to a national (Eire) court hearing, or even for ESCP? If that is the case, is there an option to withdraw and start a new one in the UK?

    Possibly. Dr Watson is the expert on ESCP in UK. The essence of it is you use the ESCP as you would a small claims court in the UK but for a claim elsewhere in the EU.
    I don't think anyone on here has ever used the courts in Eire because of the risks and seemingly difficult access use by an LiP.

    Thanks @JPears, I'll wait for Dr Watson and see what he has to say. I am assuming I can stop the process (and lose 25euros) now because I only just paid for it. But if the risks are so high, maybe it's worth starting again in the UK.
  • Hi everyone,

    I tried quite hard to find any info regarding delays of just over 2 hours, instead of the 3 hours required for full compensation, but failed to find anything relevant.

    Last weekend I flew from Stansted to Edinburgh, and the outward flight was delayed by 2h4m.
    They claimed it was because of weather conditions disrupting earlier flights and ultimately delaying ours, so a claim should be valid as the weather wasn't poor for our flight itself.

    However, given the delay was under 3h, I don't think there's much I can claim for. Really what I wanted was to recover the extra costs I had to pay to the rental car company, as when we got there our car was gone and I had to take a superior class car, which cost me a bit of money.

    Can I claim for those somehow? Would appreciate any guidance you might be able to give me.

    Straightforward answer is No. I wouldn't imagine travel insurance would cover the extra payment for the car rental.

    I wouldn't have stood for the car hire company letting your car go, especially if you've paid in advance. I certainly wouldn't have paid anything extra!

    Sadly it's in their terms and conditions that after a long delay, the selected car may no longer be available.
    I could have had a smaller one for no extra fee, but I needed the luggage space...

    I had read somewhere that I could claim for costs after a 2h delay, so was hopeful for a more positive response :/

    duty of care after 2 hours - when they generally hand out refreshment vouchers for long delays

    After 2 hours only? I'd use a duifferent car hire company next time. There are some real shark outfits out there but plenty to choose from that offer a better service.

    It doesn't matter how long your delay is, you cannot claim for consequential losses such as lost onward transportation.
