Flight delay and cancellation compensation, Ryanair ONLY

    I was due to fly on the Ryanair flight above on Sunday 2nd June at 17:00, arriving in Alicante at 20:30. However, the flight was delayed by 6 hours 24 minutes.

    On our return home Saturday 8th June, we had been sent an email from Ryanair apologising for the delay amd stated that we can claim against our insurance (which is'nt a Ryanair one) using a proof of flight delay which they attached.

    Am I right in thinking that I should claim against Ryanair for the delay under the new ruling and not atempt to claim against my insurance company? Or, should I do both, incase Ryanair say no and I have missed out on claiming on my travel insurance.

    Was anyone else on this flight and are you going to claim against Ryanair?

    One last thing, after reading all the fantastic information provided on this site comcerning these matters, am I right in thinking that a flight from East Midlands to Alicante is in total more than the 1500km and therefore we could claim upto 400 euros each compensation?

    If it was not an EC sue them Sue.Look up on this site what an ECs are. They will try every excuse in the book to put you off

    Just like alot of these claims, the reason I was given for the delay was a technical fault. We had to wait at the airport for another flight to return from Alicante to East Midlands, this was not a scheduled flight and the staff had to do extra shifts to cover our journey.

    I understand a technical fault can come under the heading of exceptional circumstances but doesn't it depend on what the fault was? Such as, if it could have been avoided, we can claim against them. If this is the case, how can I find out what the fault was and if this does indeed come under exceptional circumstances? Ofcourse, I am sure they will say it does and not compensate us for the delay.

    Also, should I contact our travel insurance company to make a claim? If I do, will that mean I can't claim against Ryanair? I don't want to claim twice but I am worried if Ryanair fails to pay out, it will be too late to claim on our insurance.

    Forget your insurance company they will not be interested
    A technical fault is not an EC

    All sounds familiar,
    You could e mail or write to Ryanair and ask for exact detail as to what caused the ' technical fault' which caused the delay. Also use one of the template letters on this site to do this and detail exactly how much compensation you are looking for. (Once you have worked out your flight distances).
    They won't respond but at least you have proved that you have asked for the reason in a genuine manner.
    You could also contact the CAA but they are swamped with cases and any response could take months.
    After that you are probably looking at having to go down the European Small Claims route-
    Again read the advice on here and get your forms submitted. Even then you might not even get a response from Ryanair and would need to push for a court judgment.
    It all might sound daunting but really isn't- one thing for sure Ryanair don't appear to pay up easily, and remember they do charge each of their passengers a levy to cover this kind of circumstance for the compensation they should pay.

    Thank you so much for the informative reply. I have printed off my letter ready to post tomorrow using a template on here, which is so helpful. However, I am a little unsure as to the time we arrived at Alicante. We receievd an email from Ryanair and attached to this was a proof of delay letter. On this letter it states the delayed flight departed 6 hours and 24 minutes late, it doesn't state what the arrival time was at Alicante. Should I use this figure or email Ryanair (which is easier said than done) and ask them this information?

    I checked the link which was provided on the Q&A page but the site is not coming up with any details, maybe it's too soon.

    Any thoughts would be much appreciated.

    I wouldn't worry about the arrival time at Alicante. Ryanair have given you a letter detailing the length of delay and stated this in black and white. You could attach a copy of this in your letter to them and wait for any response.
    Also include your e mail address in your letter. When I sent my Letter before action (LBA) Ryanair did send via e mail to me a generic response. You never know you may get a reply but don't hold your breath.
    Do still send the letter though- it proves to the court that you have made attempts to seek the reason for your delay and that you have spelt out to Ryanair what action you will take if/ when they fail to respond.

    I have sent Ryanair an email asking for both reason for the delay and also the time of the delay at Alicante. I have also requested another proof of letter, due to the fact the letter only had my husbands name on it and not mine, so I have asked for another letter which includes both our names.

    To be honest I don't expect a reply but I shall send the letter off today with my email address attached, as well as the proof of delay letter enclosed, stating that my name should be included on it.

    Dr Watson, I hope your case is going/goes well for you and you achieve what you want. Keep us informed. Hopefully we will both have positive stories to tell on here in the future.

  • This thread should get a whole slew of posts since Ryanair just cancelled quite a few flights to France. Would this air traffic control strike would be deemed as 'extraordinary' circumstances?

    Quite reasonably I wouldn't expect Ryanair to be able to predict such things from happening, but is there any way to claim for hotels being booked and airport transfers?
  • My Ryanair flight from Limoges to Stansted was cancelled this morning because of the French Air Traffic Controllers strike. Ryanair have sent me an E Mail saying I can have a refund or rebook the flight.

    I have no intention of travelling this week, but if I go through the rebooking option, will I get to choose my dates of travel or does Ryanair give me a date which I have to accept and no refund issued if I don't take it?

    I am sure I will be traveling again soon in a few weeks so will I be able to rebook for that date or get a refund and have to buy my ticket again?
