Ok let's deal with this, so RA have responded to your LBA citing 'technical issue' as the reason for your delay, not a problem, we'll beat that.
Now, ESCP and Birmingham county court......shame on you at Birmingham County Court for not knowing about this simple process.
In answer to your questions, yes £35 is the fee required to lodge an ESCP claim for the value you are claiming.
Why ESCP? Firstly so you can make a claim of a cross border nature which yours is (RA being based in Ireland and you in England). MCOL or the paper based version N1 form won't cater for this.
Secondly, by using ESCP and designating the court of YOUR choice you avoid the Irish small claims courts and any ridiculous summons to attend there and costs of this, and any ridiculous costs RA may try to claim.
As someone who was here before me said ' Keep away from the Irish courts, the Irish courts are not your friend'.
So, how do we get your claim rolling? If Birmingham have their heads in the sand regarding ESCP, try some of the other 'major' courts near to you, give them a ring and see if they are aware of ESCP and will process your claim.
If not, then use where I and many litigants I have advised used to process your ESCP claim- The Combined Court Centre in Sheffield.
There should be no reason to have to attend any hearing ( providing you populate your Form A correctly) but, be aware that sometimes the court may request an oral hearing and the presence of both parties. If this happens (and it is rare) you will be required to attend in Sheffield but, would be able to claim your reasonable expenses when you win your claim. From experience of occurrences of this - RA won't even turn up.

I've decided to press Birmingham County Court to try to process the ESCP form; I'll resubmit my forms with a covering letter clearly explaining why ESCP is the only viable route for me to use and hopefully someone there can do their research and serve it for me.
Failing that I'll try Sheffield as you suggested. Really useful advice; thank you again.0 -
A big thanks to Dr Watson and all on this forum, I agreed settlement with RA for full compensation + interest, which has now (following some delay) been paid. :beer:
It has been a long process and RA together with their solicitors really don't help the situation (that's an understatement!), but my advice is follow the advice on here and hang on in there to get the compensation you deserve!

I'm having a bit of trouble getting my money too, at first they said it wasn't their fault, so I contacted CAA and they replied saying the airline agreed they would pay and would contact me soon. That was back in June.Please allow time for the payment to be processed. If you do not hear from the airline within 8 weeks, please contact them directly with a copy of this letter.
I have tried some emails and forms but no reply.. can't find any contact email either. How am I supposed to contact them?0 -
Recieved the following initial reply

We sincerely apologise for the delay of your flight FR3883 from Malta to Luton on the
21/09/2015.
As this flight arrived at its destination of London Stansted with a delay of less than 3
hours no monetary compensation is due under Article 7 of EU Regulation 261/2004.
If you incurred any additional reasonable receipted expenses during the delay, please
submit copies of all relevant receipts to support the claim please click on the below link
and upload his documentation along with your bank details to speed up any ....

what does flightstats show as the arrival times (runway and gate) for your flight? If 176 minutes was the gate arrival time then they are unlikely to have taken 5 mins+ to open the door. If it was runway time then it is more of a possibility0
