    It would be fair to say that the regulars in here, like your good self, have a great deal of cynicism about the new scheme, I wonder why ?

    It's like the CAA threat of action ? With airlines completing the tick boxes in public then doing the exact opposite on the quiet.

    When MSE Helen posted about the Ombudsman Scheme in this very thread, my heart sunk, thinking I wonder if MSE Helen or any of the MSE team have EVER really made a claim under EC261 and the very REAL problems that thousands of us, an elite few die-hards like ourselves have struggled through, I really hope I'm wrong, but I'm not optimistic.

  • I have an interesting case and wonder if anyone has any guidance.

    We flew from Paphos to Stansted on 17th October 2015. Due to some technical reason with the plane being too heavy (too much fuel apparently), we were late in departing, AND they had to offload all checked luggage onto another flight to get under their allowed take-off weight.

    All checked luggage was put on another flight via Athens.

    We arrived at Stansted late, but unfortunately within the 3 hours time window for normal compensation routes.

    However, our bags on the Athens flight were delayed and it got even more bizarre. The Ryanair staff would not let us wait in the carousel area to collect our bags, but asked us to pass through customs to the main terminal area without our checked luggage.

    We then waited for 2 hours in the airport terminal with very few updates from their ground crew. We couldn't leave the airport, we had no idea what would happen to the checked luggage. Neither were we allowed back into the carousel area once the Athens plane had landed.

    The Ryanair staff then, after much delay brought our bags to us on trolleys, wheeling them through customs themselves. They had to wait until all the bags from the Athens passengers were claimed before deciding which were the Paphos bags....

    We eventually received our bags 3 hours 20 minutes after the scheduled arrival time.

    Does anybody think I have grounds for compensation, its a bit of a unique situation and I'm thinking they will weasel out of it saying our flight landed within the time window. It doesn't hurt to try though?

    I don't see a claim for EU261 for the reason you describe...you did not arrive more than 3 hours late.
    I personally would not have hung around the airport. I would have made a missing baggage report with the staff, left my details and would have expected the baggage to be delivered to me
  • My gratitude to Dr Watson, Vauban and the many others for their time, considerable efforts and guidance contributing to this forum and holding Ryanair to account. I was about to instigate the European Small claims procedure and decided to try writing once more with my €1600 claim subsequent to the September judgement. To my utter amazement I received a reply in early October agreeing to meet my claim in full (cheque payment). I wasn't convinced that it would materialise, however, I have received their cheque for the full amount this morning. Thanks again.

    They agreed to pay me on 27th Oct 2015 £740 (EUR1000 at that time) and asked for my bank details. Tried giving it to them 5 times via email and phone calls. Finally received a reply almost 3 weeks later on 16th November, that they have arranged a bank transfer of £712 (EUR1000) which will take 5 - 10 working days. It's now 2nd December and still no sign of the compensation monies owed.

    Guess they're deliberately waiting for the EUROS to drop further (most likely tomorrow due to the Euro Central Bank announcement) so that they can pay me less and less in £.

    I contacted them again twice since and will have no choice but to wait for their reply which usually takes over a week. Absolutely disgusting Customer Service. You would have expected it to be solved via a simple phone call but nope, they don't have complete access to their systems....

    Bott & Co won me compensation and told me it could take 42 days for them to receive the monies.

    I have no doubt that your compensation will come through eventually but you should also complain to the CAA who are already watching RA. Help yourself and others who follow you.

    Is it CAA I have to contact with? My flight was departing from Paris so previously I was told I had to complain to the French Aviation Authority. Plus, from what I've been told, Aviation Authorities doesn't really have any authority to make airlines pay up :(

    Hi,

    Just to clarify what I meant.

    I'm not suggesting you place a 261 claim for compensation with the CAA. Your claim is in hand and drawing to a conclusion.

    I'm suggesting that you report RA to the CAA for deliberately mishandling the way they have handled your claim.

    There is a prescribed way the airlines should handle claims and it's the CAA who who ensure they do it correctly. If they do not adhere to the CAA rules they leave themselves open to further scrutiny and enforcement. The CAA do have teeth, as RA and J2 have already found out to their costs and I dare say, surprise too.

    Unless these discretions are reported to the CAA, RA will continue messing claimants around by deploying delaying tactics, making direct contact difficult etc etc

    The aviation authorities are known as NEBs (National Enforcement Bodies) and you're right, they do not have enforcement powers. This is why so many cases end up on the small claims track causing backlogs in the court system.

    [FONT=&quot]Ours was a seven hour delay on a flight back to Scotland. Originally we put the claim to a well-known and respected (in this forum anyway) NWNF company. They subsequently said that they could do no more for us since it would mean going through the Scottish courts where they had no locus. Whether this was because we live in Scotland or whether it was because the flight landed at a Scottish airport is still not entirely clear to me.[/FONT]

The court issued the citation to RA who, perhaps surprisingly, failed to respond at all within the 30-day time limit. The Sheriff duly issued judgement in our favour for the full amount plus fees.[/FONT]

    [FONT=&quot]I gave RA a couple of weeks and was thinking that the next step would be to contact the Dublin County Sheriff to enlist their help in enforcing the judgement. In fact, I was contacted by a firm of solicitors based in Scotland who were acting on behalf of RA who now wished to settle the claim. OK. Not before time, and a cheque duly arrived.[/FONT]

    [FONT=&quot]So is this a result? Are we happy bunnies? Well in all of this, there has been not a single word of apology from RA for the 7 hour delay. But then, I guess an apology from Ryanair is about as meaningful as one from Fred Goodwin.[/FONT]

    [FONT=&quot]Perhaps the tide has turned and RA is starting to see sense as the legal avenues for appeal run out. It'd be nice to think so. It'd be nicer still if flights were on time in the first place.[/FONT]
