    I submitted my Directions Questionnaire but never heard from FlyBe with theirs. I have now heard back from the courts saying they have been unable to allocate a mediation date so it has been transferred to Liverpool Court for a decision by a Judge. I don't want to assume the judge will look at previous cases as that would surely be folly so should I send a further letter to the court outlining the cases which support my claim?

    I suspect it is being allocated for hearing directions. The judge certainly won't make a ruling without inviting both sides to submit evidence. What s/he might do though is ask the airline to submit a letter explaining why the case shouldn't be struck out - especially if their preliminary defence concerns something obviously not extraordinary.

    Thank you for such a prompt reply. It does seem strange especially as this was a faulty door which was discovered when the plane landed in Toulouse having flown from Birmingham. Do I need to do anything like submit additional case law evidence or just wait to hear from the Judge as it suggests in their latest correspondence?
  • Just to let people know. I have just contacted Flybe. I had the email offering vouchers firstly, then euros. I asked for sterling, at the exchange rate at the time the claim started. No problems, spoke to a nice guy called Matthew. He checked the exchange rate, £205 per person. Great result.

    I had a letter from Liverpool Court saying FlyBe must explain why the case should not be struck out and judgement awarded to me.

    Thanks to Vauban and the excellent info we have them on ropes and it's only a matter of time before the ref stops the fight!

    Could my claim be the quickest ever?


    Flew EDI -> MAN Sun 31st, arrived 3+ hrs late.


    Followed template letter + expenses claim, posted recorded 1st class Mon 1st and followed up with email later that day.


    Compensation offer email back this morning. I didn't hesitate to claim - ruined plans, onward travel and meant I didn't get to put my upset children to bed (you can't get that time back!)


    Now to get the payment in GBP rather than EUR.

    The "record" clock ticks from day of delay to acual payment in your bank :)
    I managed a very quick one recently (where I put my clim in before I had even got on the delayed flight) but I think someone beat me at 21 days or so :)

    Just to confirm they've now paid up (in GBP) and money in the account. 5 days from posting the letter to receiving the compensation - I didn't imagine for one minute it would be that easy.
