  • thanks Lynda. I had actually read that thread but didn't make the connection with Richard's post.

    unfortunately that doesn't really answer my question of whether I should continue to pursue BA or whether its actually Iberia who are liable for the compensation.

    Iberia and BA are actually owned by the same company!
    My feeling is, if you booked through BA, have one ticket, the original flight was BA and cancelled then the claim is against BA. They rescheduled through Iberia but ulitmately you were the responsibilty of BA.

    Not so sure BA aren't right. There is a good link through to BA flight forum along with the FAQs near the start of the thread. Off the top of my head I would say that if BA are sticking by their fog you ain't going to win that. I also think that Iberia would be responsible if the tech issue was on their leg of the journey. (check the FAQs on the BA flight forum) Costs aren't usually awarded in small claims courts but in a frivolous case this can change. If it was me, and probably cos I've got a Scottish granny, I would take BAs offer of vouchers, and still go after Iberia

    Just a positive note - glad to say that BA paid out promptly on our claim for 2 pax delayed over 4 hours Manc to Gatwick in July 2010. A very refreshing change. I know who I'll be flying with next trip! Well done for a decent approach to the matter. :D

    (still looks as though it will have to be small claim via MCOL for our struggle with VA - straight forward, meets requirements for compo and definitely not extraordinary circs but they are refusing to pay at the mo - shame on them) :mad:
    I have changed my work-life balance to a life-work balance. :grin:

    Hi,

    I've had a look at the article on the website but not managing to work out whether I'd be entitled to any compensation or not so thought I'd ask for advice here:

    I booked a flight on expedia from London to Rio de Janiero as follows:
    LON - MIA 13:35 - 17:45 (BA)
    MIA - GIG 20:25 - 06:00 (AA)

    The initial flight was delayed by 4hrs 37 mins according to flightstats. Reason given was they were not entirely happy with the plane so changed planes.

    This meant we missed our connection flight in Miami, and they but us on a flight 24 hours later. However there was a flight to Rio departing an hour after we landed but no effort was made to get us on that flight (the apology letter and ticket was printed before we took off in London).

    Therefore we arrived in Rio 24 hours after scheduled on Saturday morning instead of Friday morning. One of the reasons of the trip was to attend an event on the Friday and we have still had to pay for the hotel in Rio on the Friday night.

    I'm not sure if we would be entitled to any compensation for missing this event or for the delay in general or whether putting us in a hotel for the night is all they need to do?

    Your claim is against BA for the London - Miami part of the flight. Your travel insurance should cover the hotel in Rio part.

    I am currently sat in a hotel in Orlando having been told that my flight is delayed by just short of 24hrs.

    It is a BA operated flight which was booked through American Airlines. I am (was) flying back into Gatwick.

    Where do I stand in regards to compensation? Does the American Airlines booking complicate matters?
