I'm getting confused with all the regulations and differing circumstances with which qualify for compensation so wondering if anyone can help.
Our flight from JFK to LGW was cancelled on the day of the flight, we were notified around 6:30am for a 10pm flight. I phoned the airline and were told the only flight back to london that day was with their sister company American Airline going back to LHR. I'd checked before calling and couldn't see any other flights going back to LGW that day so we accepted just wanting to go home. This flight left at 10:05pm and landed around 10am the following day, almost identical flight times, however we were not at our original destination. BA provided us with coach tickets back to LGW and we finally arrived there at 12:30pm.
EDIT: Forgot to crucially say they told me it was cancelled due to a technical fault with the plane and the outbound flight was cancelled too. When checking in i noticed that the passenger load was very light however, so i'm wondering if that was a factor!
so my questions are:
1. Are we entitled to any compensation over the cancellation? As we accepted the alternative flight i wasn't sure.
2. As we arrived at a different airport are we entitled to compensation for this? We arrived at our original destination 2 and a half hours later than we should have, in my view this constitutes a delay but i'm sure the airline won't agree!
I understand that this should also be covered by the EU laws as we landed at an EU airport and BA operate under the EU regulations.
If anyone can advise i'd be very very grateful!0 -
As far as I can workout, you arrived at your intended destintation with less than the required delays in re-routing, albeit with a different flight and via a coach too.
It would seem that you are probably not due any compensation under reg 261/2004.If you're new. read The FAQ and Vauban's Guide

Crucially, what was the scheduled arrival time of your original flight?
It's not the time that you arrived at LHR that counts.
If you arrived at LGW 2 or more hours later than that, you will be due some compensation.
This is what the reg says...
(iii) they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival.

We were originally scheduled to arrive at gatwick at 9:55am, and eventually arrived at 12:30pm by coach, so yes over 2 hours late.
So, as fat as i can tell we would get compensation for the delay of arriving at our original destination, but not entitled to anything else because we accepted a new flight?0 -

Tyzap - if the OP left no earlier than 1 hour before original departure time then no compensation due, even though more than 2 hours late. Both parts have to be satisfied.
Both parts have to be satisfied for the airline to *avoid* paying compensation. If either fails to be satisfied, compensation is due.0 -

hi everyone
i was due to fly from jfk to gatwick at 10 pm on the 3/11/17 landing at 9.55am on the 4/11/17 with ba but on the morning of the flight they cancelled due to operational reasons.so they rebooked us on a flight with American airlines at 2pm on the 4/11/17 to Atlanta that's over a thousand miles further away where we then had to get a ba flight at 10.pm that night to heathrow when our original destination was Gatwick (where my car was)we landed about 10 am 24hours late and at the wrong airport by the way there were 5 adults what sort of compensation are we due many thanks.0 -
