    Hi All,

    Need your advice. My Flight from Boston to Heathrow was delayed for 10 hours. I was travelling with my 2 kids. I had filed a claim in 2014 and BA came back with the reply : -

    "Your claim for compensation has been refused because flight was delayed due to unexpected flight safety shortcomings, which prevented the aircraft operating as scheduled. Under EU legislation, British Airways is not liable for a compensation payment in this situation.

    During the final maintenance checks, we discovered a problem with the flat battery. There are numerous parts that the airline may be required to replace within a specific timeframe. These parts are kept fully stocked and ready to fit. As this particular ‘part’ was not due to be replaced, this constitutes as extraordinary circumstances.

    Unfortunately airline operations are subject to circumstances outside the airline's control. British Airways takes all reasonable measures to avoid delaying a flight in such circumstances. Consideration is given to whether there are any operational options available before a decision to delay is made. We are sorry that the delay was necessary in this case."


    How should I proceed with this? Is there any point claiming further?

    By law, a flat battery is not an extraordary circumstances. So you are owed €600 per person. Whether you think there is any point in claiming further is for you to decide. BA may now pay up, in the light of the Huzar Judgement of last year - particularly if you wrote beforehand. Maybe try writing again and, if they still resist, take them to court.
  • Hi - I'm about to start a claim for a delayed (then cancelled) BA flight last month and would appreciate some advice - have read FAQs and Vauban guide (thanks - v useful) but am still unclear.

    - 2 adults & 2 children
    - connecting flights from UK airport to GIB (both BA)
    - domestic flight eventually cancelled after 10h and booked onto next flight which departed 12h+ after original scheduled time - so missed connecting flight
    - stayed in LHR hotel overnight
    - travelled to GIB next day (another delay - think that flight was 2h late departing)

    Two main questions:
    - can we claim for the amount based on the total travel distance ie to GIB rather than just within UK?
    - can we claim for the EU compensation per person plus hotel/subsistence/travel expenses?

    Any advice would be very much appreciated - many thanks.

    Yes (assuming it was one ticket and not two separate ones) and yes.
  • Hello all,
    I've seen a lot of information about flight delay compensation, but this is a little different.
    A few weeks ago I had a flight booked with British Airways from Manchester to Heathrow, then from Heathrow to Budapest.
    The Manchester to Heathrow flight was scheduled for 1555h on the Saturday.
    At just before 1700h on the Friday, i.e. with less than 24 hours' notice, I received a text message from BA stating that my flight had been cancelled.
    I was still at work at the time and you can't imagine the level of stress encountered whilst trying to get another flight, and re-arranging the transfer at Budapest airport with a separate travel company, all whilst travelling home on the train!
    The original plan was for my parents to drive me to the airport, which was fine because it was in the middle of the day.
    However, the only option BA had for me was a much earlier flight. This involved a very early start, which was too early for my parents. I therefore had to take a taxi to the railway station, then a train to the airport.
    My question is now whether I am entitled to a refund of the taxi and rail fare.
    I'm not after compensation as such, I simply want to be redressed for the expenses I incurred because of the re-arranged flight.
    Despite repeated requests, BA have still not divulged the reason for the cancellation of the original flight.
    One other thing - this flight had been organised through a travel agent, who BA neglected to inform!
    I've been directed towards regulation 261 and Vauban's guide, but these both appear to be for delayed flights. Mine wasn't delayed, it was effectively brought forward, but at significant inconvenience to me.

    Your flight was cancelled and you were re-routed.

    The Regulation says on cancellation and re-routing:

    1. In case of cancellation of a flight, the passengers concerned shall:

    (a) be offered assistance by the operating air carrier in accordance with Article 8; and



    (c) have the right to compensation by the operating air carrier in accordance with Article 7, unless:



    (iii) they are informed of the cancellation less than seven days before the scheduled time of departure and are offered re-routing, allowing them to depart no more than one hour before the scheduled time of departure and to reach their final destination less than two hours after the scheduled time of arrival.

    Yes - all on one booking reference with one ticket number PP for the two flights.

  • I flew from EDI to LIS on 15 July. My original itinerary was:

    BA1441 EDI-LHR 10.00-11.40
    TAP0359 LHR-LIS 13.45-16.25

    BA1441 was delayed because of mechanical failure and I missed my connection so BA rebooked me on

    BA0502 LHR-LIS 15.25-18.05

    BA0502 was also delayed because of mechanical failure, so I eventually landed at LIS at 20.18, and the total delay to my journey was 3 hours and 53 minutes. I thought this made me eligible for delay compensation, although I can't find anything in regulation 261 which specifically addresses two delayed flights like this. BA has rejected my claim, because the rebooked flight was _scheduled_ to get me there within 3 hours. Do you think they're right, or is it my actual final arrival time which counts?
