    there appear to have been a significant number of delays at Gatwick on that date so the reason will be key to whether compensation is due or not
    From their response they seem to have assumed that they chose not to travel on the flight so their seems to be some confusion

    However, my flight was delayed for 9 hours last December, the reason given was birdstrike (we were turfed off the plane as the captain noticed the damage on his final walk round) and this was the basis for Thomsons refusing my claim. Many months and letters later, I issued a claim, they acknowleged and said they intended to defend, then a week later phoned me to settle !!!!

    I don't know what the 2nd delay was (technical fault to the replacement plane - they never expanded on this) so I don't know if they eventually paid up because of the birdstrike, 2nd delay or 3rd delay (crew out of hours) but given the recent judgment, I would definitely pursue it.

    Quite right, although not necessarily even that useful.

    SirGimpy, we know how you are. This is a help forum to help those who wish to claim rightful compensation who do not have the means of millions or lawyers and airlines and follow the rules.
    Members of this forum come here for help and other members suggest what they think to aid them, many have already been through the process and wish to pass that on to other members to give them confidence of such an undertaking.


    You may not like what is being discussed in the forums as we can see from your posts you are pro airline, I have not seen one helpful post from you only disagreement along the way. Please if you wish to help then please be positive about it rather than giving the l opposite, we love to have you on-board to give us your take on it from a passenger perspective, if you post on here to counter argue advice given by members then all you are doing is trying to dissuade members from claiming therefore it is not in the interest of the forum. Remember we have members on here that have took on the airlines right to the top courts and won, yes you know who and what I mean.

    Hi guys

    I didn't think I'd be eligible to claim (I pushed for Avios points!), but someone mentioned I should claim.

    Through ticket (package booking) Newcastle to Vegas :
    Depart Newcastle noon, connect Heathrow then onto Vegas. Purely by chance at 7pm the night before travel my daughter checked emails to find one from BA saying flight from Newcastle cancelled and to ring for advice. Got through and offered the 6am flight (no earlier flight to Vegas so 10 hr wait in LHR ) or Tavel next day. This wasn't an option as we were only away for 4 days and had trips, shows etc booked separately which totalled almost £1000.

    As a result I had extra airport car parking, rushed arrangements to find someone to look after dog and get to kennels as we were planning on doing the morning of our flight plus of course the expense of a 10 hour lay over.

    The 0600 flight was also cheaper than the noon when we booked but the noon flight suited us better.

    Anyway, all BA will say is that they got us on the flight less than an hour before the original time! Erm, I make it 6 hours difference!!

    As a side note, they have got so much info wrong in their emails - saying flight was me and my daughter when it was my husband and I, saying flight had gone tech yet when I rang after receiving email was told the noon flight was 1/4 full so moving passengers, plus of course no text or call despite the fact I'm an exec club member and they have my details.

    So, just after thoughts and opinions please

    Ps - they also advised claiming on insurance but with excesses it's not worth it

    It is more than likely you are due compensation, regs state quite clearly if your flight is cancelled at short notice, even if it means an earlier flight you are due compensation.
    Ignore their excuses.

  • Hi.

    I'm just wondered ring if anyone can give me some guidance on a recent Delayed flight I was on

    I've rput in a claim to British Airways for a flight from Rome to Gatwick on 11th July 2015 which was delayed By 3 hours 25 minutes.
    They have refused my claim as they say the delay was out of their control, and due to Air Traffic Control.!
    However, we were informed by the Captain when we eventually got on board, that his Co Pilot had not turned in that morning as he was sick. !Whilst he was waiting for a new one to be assigned to him, he lost his crew to another plane. Then he said they took his plane off him and he had to wait for another plane to become available which at the time was undergoing routine maintenance. He then had to wait for a new crew to be allocated to him.!
    We were left waiting at the departure gate in Rome for almost an hour with no one informing us what was going on. Eventually we were allowed on the plane and by this time they had lost the time slot for take off. There were subsequent problems which they are blaming on Air Traffic Control, but the original problems were in their control and caused the inbound flight to be delayed which subsequently delayed our departure and landing times. To top it all off just as we were about to land, the aircraft zoomed back up in the air and had to circle the airport again before landing. We were informed that this was due to the cabin being insecure. We believe there was a passenger still in the toilet. Whose fault that would be is beyond me.!
    Do you think they are right in refusing my claim, or should I go back to them.!
