I am not sure if I'm making myself clear.

I booked through expedia, one booking which was 2 flights each way so therefore I'm not sure on the ticketing thing, it was just one email and printed 2 boarding passes for each flight not tickets as such as it's all on one booking itinerary rather than 'tickets'.
You see as I see it it was one booking for one journey from Man to JFK with BA for the whole thing, they may see it differently.

    Hi gillybean,

Thank you for the additional information, TBH, I'm not sure, I'm no expert on this multi hop can I / can't I claim business. It really is a tricky one and relates to many different past Judgments and legal argument on both sides, Mark2spark, Vauban, JPears or 111KAB are really the ones to best answer your post, now that you have finally :p;), given a clearer picture.

Just be patient, and they will help...

    Cheers,

  • Hi I was on flight ba0095 from heathrow to montreal on 27th March... Flight was delayed 5 hours. Has anyone successfully received compensation for this delay, I know some people got emails advising they would be entitled to €600 per person ... How long from compensation confirmed until payment received ? I have not received anything back yet.

I would expect 2 weeks to be a bit of a short timescale from delay to payment. If you have not heard back from BA after a month then you could go back with a NBA
Did you contact them through the website or by letter?

AFAIK, I hold the record on claim submission (on day of actual delay) to actual payment in bank, at 24 days.
So 14 days is perhaps a tad optimistic ;)

It seems as though we've run out of steam on your scenario, I would have a chat with Bott & Co and possibly see if they will take your case, only a legal viewpoint may be able to help you further.

    Good luck

Advice please. BA flight from New York to Heathrow was 12 hours delayed (overnight) as pilot was ill and a replacement had to be flown out from UK. BA have refused my compensation claim stating:

"If a flight is operating from London Gatwick or London Heathrow, our base airports, then it would be expected that we would have standby crew available. However, this flight operated from New York, and we are not able to have standby crew available at every outstation that we operate from. A replacement was flown out from London, and so all reasonable measures were taken"

    and,

"Article 5.3 of the EU Regulation 261/2004 states that a carrier is not obliged to pay compensation if it can prove that the delay or cancellation is caused by extraordinary circumstances that could not have been avoided even if all reasonable measures had been taken. I regret, therefore you are not entitled to compensation under the EU Regulation for your delayed flight"

Are they trying to squirm out of paying and what should my next step be?
