    If it's to do with claiming I would definitely recommend writing to there registered office, and not phoning them.

  • We travelled from Edinburgh to Rome last week via Heathrow, and unfortunately the first flight was delayed 1h15 and we missed the connection to Rome. The next available flight got us there 4.5h later than originally scheduled.

    We were told the initial delay was due to waiting for a de-icing rig to de-ice the wings. That arrived, but no de-icing happened and the captain then said we would be further delayed while waiting for a second de-icing rig.

    Other flights around the same time left on time or with very minor delays, and ours was the only one anywhere near that long.

    I know BA will claim it's weather-related and therefore an extraordinary circumstance - but since other flights weren't affected and there were no airport or air traffic restrictions at either end, I don't believe this is correct.

    What are my chances of success?

    I've submitted a claim via the online form but have yet to receive anything other than the automated acknowledgment.

    what date was the flight? what does flightstats show for departures around that time?
  • Hi, I had a more than 24 hour delay on a flight from Kefalonia to Manchester in September 2011. I couldn't find BMI in the list of airlines and on checking Wikipedia found that BMI was acquired from Lufthansa by International Airlines Group (IAG) on 20 April 2012, and was integrated into British Airways (BA) by 27 October 2012.
    Can I pursue a claim against BA for the delay?

    Yes you can, but it would help your cause if you still have your boarding pass and confirmation details etc as they will ask for proof of booking.

  • Hi Invalidation, I think we were on the same flight. I haven't been offered anything yet. It took ages to get a standard reply back, citing that it was 'delayed due to aircraft damage, which was not caused by British Airways, which prevented the aircraft operating as scheduled. Under EU legislation, British Airways is not liable...'

    What did you do to get the €100 offer? And do you think the case has a chance? I heard the plane had been hit by lightning in London. Putting in flight details on a compensation site (I forget which) had told me I was unlikely to get anywhere with this particular case and I was on the point of accepting this and just going for hotel fees until you mentioned this.

    They have stated to me that the incoming flight to LHR was hit by lightning and the checks took too much time.
    So the incoming flight hit by lightning which was then to be rotated as BA009 to Bangkok then Our flight BA0010 from Bangkok to London, and that it was 'Extraordinary Circumstances'. My point to them was that it wasnt even out flight or the flight before us that was hit yet they still cancelled the flight and rescheduled it for 22 hours later, despite having spare aircraft and a crew that was ready to fly. I never asked for anything yet they offered me a 100 Euro eVoucher which I take to be an admission of liability.
    The DWP = Legally kicking the Disabled when they are down.

    Interesting and have a read of this by our very own Mark2Spark, http://forums.moneysavingexpert.com/showpost.php?p=59429463&postcount=580 , sounds to me like you DO have a valid claim under EC261/2004 although the case wouldn't be without some difficulty.

  • I have put in a claim for €600 to BA for a 22 hour delay of BA0010 on 21 October, from Bangkok to London.
    They have stated that, the incoming flight into Heathrow which was then to be rotated as BA009, then to pick us up in Bangkok as BA0010 was hit by lighting causing the delay to BA009 and then knock on effect to out flight BA0010, so it is Extraordinary circumstances.
    However it wasnt our flight which was hit, or even the flight before us so how can they claim extraordinary circumstances to our flights? and that not even mentioning that Heathrow is BA's home base and they should have had aircraft around to fill the gap.
    How many aircraft back can they use as extraordinary circumstances? to avoid paying compensation?

    There's also another problem in that they failed to offer economy passengers any rerouting onto other flights and when I asked at the Bangkok desk was simply told they could not reroute us yet they DID reroute several Business class passengers. And another little fault is that they failed to advise us of our rights under Article 14 of the EU Regulations, either verbally or by way of a 'handout' which is their obligations to inform passengers of their rights

    None, if it wasn't your flight that was directly affected they cannot claim Extraordinary Circumstances.

    You have a valid claim.

  • Just to say thanks to the boards and log another compensation success.

    Claimed for a delayed BA flight BA0253 to TCI on 7/9/14. Original complaint was pending the Jet2 ruling but when prompted after that they were very quick to respond and pay out.

    I was in 2 minds whether to claim as they looked after us very well and put us up in a hotel overnight but in the end it was a whole day out of a week's holiday all for the sake of an oil filter...

    So in the end we got back (between 4 of us) almost the cost of one of the flights so we are happy.
