    How much would this cost someone in legal fees if they were to lose their case in court?

    And is there any way of finding out the exact cause of the delay from a flight before it gets to court?

    i know there's lots of advice on here but please guys, get on with it! The procedure is simple. Write to them once, asking for compensation. Write to them again, reminding them of letter one. Write to them again saying that if they don't pay you will take them to court. Take them to court!

    Each letter should have a time period stipulated (28 days is the norm). So in effect 3 months and then on line court action.

    Following the brilliant piece on here recently of a success when thompson have said 'exceptional circumstances' and 'routine maintenance' was the counter arguement then surely it's a confidence booster.

    My 28 days from service is up next week. Watch this space.

    I beg to differ slightly. The CPR pre action protocols demand that the parties make reasonable attempts to settle before court. This has been deemed to be an initial claim letter giving 14 days to consider your claim and then a NBA letter giving a final 14 days to settle or you proceed to issue a legal claim withiut further notice.

    spot on with the 14 days and cpr etc. Just habit to give 28 days as I tend to begin an action at the start of a calendar month!

    We phoned the local County Court to enquire what the progress was in our case.
    We were told the date and time will be in the post today.
    We were also told Thomsons allocation questionaire was 3 weeks late, will this have any bearing on the case.

    I also took Centipede100's advice and phoned the Helpline (01640 4619402 for anyone wanting to avoid the 0845 number) and they also confirmed that a copy has to be sent to the defendent.

    Hi All,
    Thanks for all your advice on the forum. I hoped I could pick some of your brains on a direct question I have however. I had my claim turned down from Thomsons due to it being 5 years ago. I've just received this reply from CAA this morning. Would it be advisable I now leave it with CAA, although they've already admitted it will take a long time (I chatted with them on the phone and it seemed like it would be months/years), or, as they've stated they are lying on the side of the law being 6 years, that I take this info back to Thomsons and use this info in my final letter before court?

    "The CAA’s view is that in the UK the time limit for bringing a claim to court for compensation for denied boarding, cancellation and long delay is six years from the date of the delayed flight. We understand that Thomson Airways have taken a different view and considers that the limitation period is 2 years. We will be taking up your complaint with Thomson Airways, but it may be a while before we can respond to you with any more detail."

    Just start a court case - if that's their only defence, you have a guaranteed win.

    We were due to fly back to Manchester from Palma, Majorca in Oct. 2011 at 7.30 p.m. The plane, so we were told, had been sent to Mexico and the plane sent for Majorca was inadequate for the number of passengers. As a consequence over 90 passengers were left in Majorca until the following morning.
    A flight did take off and land but it did not have us on it. The flight that we did travel on the following day does not show up on the linked website. I have written to Thomson on 28 March and again on 20 April. So far no response. It would be interesting to know if anyone else inconvenienced by this has made any headway.

    Whilst staying in Cape Verde last week, a message appeared on the Thomson reps board saying our return flight was going to be delayed by 4 hrs. We learnt this some 3 days prior to our return flight home. Does this constitute a delay and can we claim compensation for the "delayed flight"? Apparently, they had a plane waiting for us, but no flight crew, who had to be flown in from another island (hearsay only)
    We were shipped out from the hotel several hours later than scheduled but were fed and watered by them.

    It all depends if your arrival is delayed, not you departure, so were you late arriving by more than 4 hours?
