I called Thompson last week after waiting the 56 days (+ another week for good measure) since completing their Claim form for a 3 hour+ delay to Florida in August 2012. They apologised & advised that 56 days was a guideline & that they are currently dealing with claims that they have had for 70 days (10 weeks)
I'll be interested to see what their reply is after all this time
Spoke to Thomson on 18th April (around 80 days) & at that point, case had just been started. now almost 100 days & they're still looking at our claim - has anyone else had such a long wait ?0 -
My Acknowledgement of Service was due and submitted 23 April. By my calculations Thomsons 'defence' which I assume will comprise of two year Montreal limitations and extraordinary circumstances is due 7th May. Not long to go now. Hopefully will have a hearing date soon.0

It was a 'rescue flight' to pick up these other passengers and 'unexpected flight safety shortcoming' after a technical fault that would not have not been discovered routinely.
Now, CLEARLY it is not EC. There was no problem with our flight & there was nothing stopping them deploying another aircraft from picking up the other passengers which experienced technical problems with THEIR flight.
Question: apart from writing my NBA saying that ^ (and bypassing caa), what other laws/guidance should I be quoting please?

Following on from this & advice provided by centipede & couple of others, Thomson should be replying by Tuesday latest after my nba
which basically says that there excuse is !!!!!!!! and to cough or its rumble time in court :rotfl:
Now, I don't really have the time or knowledge to do the 'court thing' myself (unless someone can convince me otherwise)
So, anyone used a no win no fee service they can recommend? Do they pick up where you left off? What fee do they take? And what stage are they at with that.
Although I need to double check, I think the holiday was paid on cc0 -

I don't this it's for anyone here to try to convince you to take it to Court - only you can make that judgement about whether you have the time, ability, money and motivation to take it all the way through.
The no-win no-fee companies take about 30% of your award. You'll need to do your own research on who sounds good - I've no idea. You'll also want to make sure they'll take it to court on your behalf (some just write letters, apparently, which you've done already).0 -

They will almost certainly put in a defence of "Montreal Convention says 2 years" followed by "In the alternative ... it was an unexpected technical fault and therefore extraordinary circumstances".
That is what they put in their defence to my case. Neither is valid and the machine rumbles on.0 -
190 days ago Initial full claim sent by letter for a 3hr 40 mins. delay in arrival at Faro.
80 days ago Completed Thomson ' Official ' Claims form sent.
Knowledge of the requirement for such a form was only determined from reading Thompson's own blog. 'Your Stories'
Thomson's could not be bothered to inform me of this even though they had sat on my original claim for some 110days!!!
12 days ago -Phone call, from Thomson's after much chasing, saying that they had got the completed form and were passing it for 'Fast Tracking'
May 5th. 2013 Still waiting. .:mad:0 -

I have referred mine to euclaim.co.uk but they say it will be 4 to 6 weeks before they take it up properly as they're so busy with these!0 -
today was the day that Thomson were meant to file their defence by.How long should I give them before asking the court to make a judgement .I realise that they cant actually file anything today or tomorrow but shouldnt they have done it by friday in that case

Give them until Friday of next week, then press for judgement.0
