Panda. You need to print out the Claim Form and then write your mothers name in red ink with the words "second claimant" also written in red. She must also sign the form. You may also need to change the details in the particulars of claim if they are different to your own. You then send one copy to the court and one to Thomsons legal team at the address contained in their defence, keeping a third copy for yourself.0

we've just had conformation from thomsons of a full payout as asked for in our initial complaint @ 540 p/p and we have only just started a cedr process. Anyone else had the same from them?0 -

My Flight to Crete was delayed 5 hours 20 minutes in August, mid-September I e-mailed Thomson, no reply, In October I wrote registered post still no reply. I have phoned twice to be told they cannot deal with the issue but will pass on details of my call. How do I get a response from Thomson?0 -

they appear not to commit to a response time "We process all claims in the order in which they are received. For flight delay claims we thank you for your time and patience until you are contacted."

I would be replying to CEDR asking what role they see in enforcing their judgements as airlines are clearly ignoring them.
If they are not going to enforce, quite frankly what is the point of existing in the first instance?
So one week after contacting Thomsons on the address given by CEDR, I have heard nothing and received no payment. I have now sent a emsil to CEDR with the following:May I ask, as CEDR have now put the onus on me to pursue with the Thomson legal team, what action CEDR will/ can take to bring this to an end? I had thought that CEDR acted in a similar way to ombudsman services, but it seems that airlines are under no obligation to a) participate in the scheme they voluntarily joined and b) comply with the decision given by adjudicators of the scheme. I am also beginning to think that I will still have to apply to the courts for payment as I believe CEDR do not have the powers to enforce any decisions made by their adjudicators. If this is the case, the CEDR scheme would seem to be just a time wasting exercise to give airlines more time to wriggle out of their obligations.
Apologies if this email comes across as harsh, but 6 months down the complaints process, and having completed the ADR scheme, I am no better off than I would have been had I just issued a county court summons immediately.
The reply given was:Thank you for your email and no need to apologise – I can completely appreciate the frustration!
We had a conference call with Thomson on 9th and we spoke to the head of their legal department who asked that all passengers with outstanding payments emailed him so that he can chase them up personally and this is why you received the email directing you to him on Tuesday. We communicated to them the seriousness of their non-compliance. The airline are bound by the decision and so cannot refuse to pay it. Once the details are received by Mr Schwab he assures the payments will be raised that week and therefore the payments will be with the passenger’s the following week.
However, you are more than welcome to pursue the payment via the Small Claims Court should you wish to do so. Also, if you would rather, you can send your BACs details to me and I can pass them onto Adrian.

CEDR have informed you that Mr Schwab, head of Thomson legal department, has given an undertaking that your money will be paid within a week, once you have supplied your bank details.
Thats a good result in my book.
Of course you can pull out and start MCOL proceeding yourself at any time, it is only a voluntary service. But why would you given the above undertaking?
