    I quoted the cases and their failings to them.

    IMHO you shouldn't do this, just stick to simple facts rather than exposing your defence.

    Have decided to persue claim through court ( encouraged mainly by the wise words of Vauban, tyzap, legal magpie and novice angel).

    From what we were told at the airport the fault was down to the radar on the plane, with a new part being sent over from the UK.

    so thomson have rejected my claim for compensation and food costs stating their delay logs show that my flights were delayed "due to adverse weather conditions on the sector prior to your scheduled flight. This then caused a knock on effect to your flight and the subsequent delay."

    Then quotes extraordinary circumstances due to weather.

    They also dated the letter 04/03/2015 when the letter was franked on 01/04/2015 which is a bit strange...

    I was delayed both ways flying to Mauritus from Gatwick and back, I think the plane came from goa, india but I cant find this information online anywhere

    I sent a LBA last week so thinking of starting a money claim

    so my claim will be based on wallettin that they did not use all the resources available to prevent the delay as they could of used another plane.

    Does anybody know what case I should quote to backup my claim for food?

  • :jInitial claim letter sent May 2013. Got the usual 2 year blah, blah blah response. Second letter sent mid-March (after the test cases determined) & a lovely cheque arrived for sterling equivalent of 1200 euros (2*600) on Saturday. Obviously didn't expect this to have been quite so easy & that it was is down to those who battled their cases previously. To them & other Forum stalwarts many thanks.:T

    Hi all, have posted a couple of times on here and am about to a)issue a NBA to Thomson or b)pass it to a NWNF company. Before I do this, is anyone able to give me a definitive answer......?


    Thomson claim my flight was 'delayed due to adverse weather conditions causing the previously affected flight to divert. This then caused a knock on effect to your flight.'


    So before I go ahead and so I dont make a fool of myself....do I have a claim because it was a knock on or are they correct that I don't have a claim because the weather is 'extraordinary circumstances'

    We have received notification today from the court informing us that Thomson are intending to file a defence......is this normal procedure by them ?

    Our claim is for a 5 and a half hour delay as result of a 'knock on' due to weather on the previous flight and the pilot running out of his 'flying hours'. Therefore they had to source another pilot to fly our plane home. We have got this in writing from Thomson, although only recently and I have not forwarded this to the court - should I do this ?

    Any comments would be much appreciated as usual - I am fast losing the will to carry on :(

    Yes, exactly the same reason Mitzi and I'm also loosing the will...and I'm only on my third letter, hence why I'm considering using NWNF (but seeing as I'm tight, I want to keep all of the money for myself :))

    If you read my post 6812 you will see that I received an out of court settlement for the EC's stated in your post. Don't give up but be prepared to fight your corner.
