    Yes it is apparently with the courts but I'm only getting 1 line answers from Bott&co. They advised me about 2 months ago I would definitely be paid out after the result of the Dawson case. . It's only after numerous chasers to them, that they have just mentioned the case is with the courts as Thomson are claiming adverse weather caused the out coming flight to be diverted.

    This is the first I have heard and does not tie up with the information we given back in 2009. But obviously I have no hard evidence.

    Bott & Co are getting a push on the forum but from my experience they are very slow in keeping people informed. It wasn't until the 16th March that they put out an e-mail regarding the Allen case 3 weeks after the court date.

    To be fair, a write up and the full judgment was on their website within a couple of hours of it been released by the Courts... I personally would have thought that once you hand your case over to any NWNF solicitor you wouldn't want chapter and verse on every decision that may or may not impact on your own, I would have thought you'd just sit back and wait for the money to arrive?

    I've never used Bott & Co myself but as a regular forum poster I read more positive than negative I suppose no they are not perfect but they seem to do very well.

    Not sure why it is, but 12th Dec 2013 was the last time I received anything from Thomson, they have not been in touch with the Court since then either. Over 15 months of silence.

    Just to let you know that I am still alive and well, Thomson, I decided not wait any longer for you pay up (as ordered to a month ago) so have engaged an HCEO.

    You are out of time.

    Does that sound familier Thomson? You once said that to me. It turns out though, that when you said it, you were wrong!
    The above is just my opinon - which counts for nowt! You must make up your own mind.

  • I have sent a claim to Thomson for delayed departure for flight TOM1552, 27th February 2015(9 hours) and wondered if anyone else on this site was on that flight?
  • Hi All. Regarding the claim that we made recently to the small claims court a 'Notice of Part Admission' has been received today from Thomson. Our total claim was based upon the exchange rate on the date of our flight home which was 1.14 euros to the pound. We also claimed for interest from the date of our return trip home. Thomson have offered a lessor amount that is based upon a current exchange rate of 1.37 euros to the pound and said that the interest payment is not applicable due to the fact that "compensation" under article 7 of the Regulation does not constitute "the recovery of a debt or damages" as defined in s.69(1) of the County Courts Act 1984. The difference is quite a lot and they are offering us £1,089 less than we have claimed. Can anyone advise on the exchange rate that should be applied? Can anyone advise on the entitlement to interest? I have to reply by 18 April so any help/advice would be most appreciated. Many thanks

    Hi there. I have just posted a comment regarding a part admission received today. I noted your post with comment that states that you received a payment based upon the historic exchange rate at the time of your delayed flight plus interest. My offer is based upon a current exchange rate and they have said that interest is not eligible????? This makes a huge difference (in excess of £1000 presently) as the pound is so strong against the euro presently. Also, because the claim dates back to 2009 the interest is quite significant as the claim was for four people. Can you advise at all??? The post I am referring to was from user name SMARTLY posted on 24 March 2015. I am not allowed to copy in their post as I am new to this forum!

    They are right about the exchange rate but wrong about the interest assuming that you claimed interest in your claim form. If you feel that it is significant you should reject the offer and tell the Court why. Ask the Court to refer the papers to a judge and ask that the Judge grants you judgment for the amount admitted and lists the case for a short hearing (30 mins) to argue about the balance.
    Thomson will probably increase their offer to avoid the hearing
