Flight delay and cancellation compensation, Tui/Thomson ONLY

    Cheers both. Will get on this first thing in the morning and keep everyone updated.

    Reason for flight delay was "pilot was sick" but don't have any proof of this but we were told this on arrival to Malaga airport from resort. Cannot wait to see what BS they try to pull!

    EDIT 2: I see from post #2 package holidays are covered so this notice from Falcon is BS? I should start to complain against Thomson directly or?

    That part of the terms and conditions refers to your actual holiday eg problem with accommodation, transfers etc, not EU compensation. All tour operators have that condition. It simply means you cannot be home 4 months and then decide to complain about your accommodation in the hope of getting some money back. You only have 28 days from return date, to lodge a complaint.
    Claiming EU delay compensation isn't a complaint.

    I would like correct address too as I am about to send NBA to Thomson for both my delay (2007) and my parents delay (2012).
    My own trip is outside of the two year "rule" and my parents trip, which I mentioned further up this thread, is in regard to a technical problem on the plane that Thomsons claim does not fit the payout criteria.
    I have had a look through here but can't find anyone who has started Action and subsequently updated in regard to this Montreal rule.
    Also, I had a quick look at MCOL website and I know how silly this sounds but do I make one claim for my trip ? ie my husband and I were both delayed for 24 hours returning from Jamaica in late 2007 ( I know its a long time ago but I did actually start this a fair while back). Can I claim for him as well or does he have to do a separate claim under his name ? obviously the tickets were bought at the same time and with the same money.

    Don't know what an NBA is but.
    We have started a claim in the S.C.C. and submitted a joint claim both signing the documents.

    Their submitted defenc was Montreal ignoring our 261/2004 claim. We commented rejecting this on the Allocation Form.

    NBA = Notice Before Action
    It's the letter you must send in order to comply with (Court) pre action protocols.

    Did you quote the More ruling from the ECJ?

    All correspondence with Thomson Airways should go to their Head Office.
    This is also the address that was on the bottom of the papers we have received from the court.

    The template is on this site somewhere. I also think there are templates on the Holiday Which page.
