    Out of Court settlement

    I first wrote to Thomson in Nov 2012 but did not receive a reply to that letter and subsequent letters so following the advice on this forum I issued my NBA and had my first hearing in Nov 2013. My case was stayed pending Dawson and my second hearing was scheduled for Monday 23 March 2015. My claim related to flight TOM656 from Birmingham to Antalya on 15 June 2010.


    However, last week I received a call from Thomson asking If I would agree to an out of court settlement but their first and second offers fell short of the 800 euros that I was claiming. I suggested therefore that I would only consider a settlement that paid me £670 ( the exchange rate of 800 euros in 2010) and my court fees of £140, but said that I would forego any interest amount. I am pleased to say that today I received a confirmation email to this effect.


    If anyone is interested, their EC's related to a knock on effect from previous flights that were subject to ATC action and bad weather.


    I would like to thank the many people on this forum for their help and advice in preparing my court bundle. It does take time and effort but help is freely given. Good luck to those still going through the claims process and do not be deterred by a lack of response from Thomson - it appears to be the norm.

    Well they say you learn something every day and whilst I was aware of Flightstats web site, I knew nothing of plane finder so thanks for that. I'm off to try and find the reg number of my delayed plane. I know it was a Boeing 737-800 series, and I have the flight number and date,so its the reg no I will be looking for. Thank you very much.     Hi,
    I am having trouble getting the reg no of the plane off plane finder. Its clear, I must be doing something wrongicon12.gif. I have the flight number and it is a Boeing 737-800, departure time, date and airport and that the number begins with a G. What else do I require please? I too would like to write to Boeing explaining the situation. Thanks again - Sally
  • hi i am new to the forum, i thought i would post my experience with thomsons incase it can help anyone else. I put in a claim to thomsons via their online contact page, on 30/1/15 claiming compensation for a delayed flight for 3 passengers from orlando sanford to glasgow on 25/7/14 for a 24h delay.I used the templet letter from this site. Out of the blue today i received a letter from thomsons stating that our delay was due to operational issues, with a cheque attached for £1310.00:T:T, 600e per person. Flight no was tom743

  • After a number of years since my flight delay (incident was in 2010 with a 19 hours delay from Gatwick to Reus in Spain), my solicitors are issuing Court Proceedings against Thomson.

    Although my solicitors are operating a No Win No Fee basis contract to deal with my case, there may be costs involved if I lost the claim. Did anyone here take out special insurance to protect themselves against the costs and how much does it cost?

    I am uncertain whether I was insured through my household policy (Family Legal Protection) back in 2010 or whether I can use my current insurance policy which does have Family Legal Protection.

    If I do need a policy, can anyone recommend a company who specialises in this type of policy and do I have to take it out prior to it reaching Court.

    Any help anyone can give will be massively appreciated.

    Personally I think you are worrying far too much. If your solicitor has agreed to take on then he must have thought you stood a good/reasonable chance and it you want to ensure he is fully briefed instruct him (after all you are, in effect, paying him) to read Vauban's guide - references everywhere on this thread.


    After he has read said guide yours should be a 100% case in your favour. If you want to check on your household policy it needs to be from the year of the policy ie your delay was in 2010 you need to approach your insurers on that date.


    I doubt very much that any insurer will accept the risk for the cover you require - not that it is a great risk just that the necessary research to ascertain the level of risk would not be worth the effort. NO ONE on this delay forum (insofar as I am aware) has had costs awarded against them.


    Tell your solicitor to stick around ..... he may learn something ...... in fact something the Monarch (and others) solicitor seems unable to grasp > hope your guy is brighter!

    111KAB is of course 100% correct, this does crop up from time to time, you have to remember that this is a small claims case and that the process is designed for LiP's to take on LiP's the fact that the airlines, employ barristers at a huge expense is a matter for them, not yourself...

    I don't believe any DJ would award costs apart from court fees, to the successful claimant or defendant.

    Costs are normally only ever awarded if either party acted wholly unreasonably and simply losing your case if not acting unreasonably.

    Don't worry, leave it in the hands of a good NWNF solicitiors and you'll get your compensation.

    I used a nwnf solicitor and won in court, still waiting for my payout, was advised on Tuesday that they are now in the process of sending in the high court bailiffs!

    So, I decided to use a NWNF solicitors firm which is well known on this forum. They have contacted Thomson with my claim, but thus far have had no response, and a further reminder has been sent.

    I'm not surprised though, Thomson has a lousy reputation for poor communication, they probably hope that by ignoring claims they'll simply go away.
