  • Just to let people know of my outcome, used the template on MSE to write to Thomson using this address...

    This was for a flight delay of over 26 hours from Egypt to Manchester on the 3/2/2015, wrote the letter the same day as we arrived back home and we have just had a cheque off them for just over £901, very happy with the outcome and how easy it was.

    This morning I received a cheque for £600 from Thomson. Took over 2months and they didn't ask for tickets. Thanks MSE without the template I don't think I would have received anything. :beer:

    Well done to you. I am nearing the end of the 14 day NBA letter (ends Wednesday 18/03) but, not surprisingly, no acknowledgement etc., from Thomsons. Would you mind sharing the reason for your delay in the first instance please?

    If I am successful and the court gives Thomson a dated to pay our compensation, say in this instance tomorrow, what is the likelihood in peoples experience that I will have to request full judgement?

    I don't quite follow, Sue. If the judge orders Thomson to pay, then that is the judgement.

    Do you mean what is the likelihood that you will have to apply to have the judgement enforced (ie to call in the bailiffs)? You shouldn't need to.

    Sorry not great with the legal jargon!! Yes Vauban that is what I meant.

    Quick update I just called Bott & Co who I used to sort this out (there were 15 of us on our complaint and I didnt want to mess it up!)

    Thomson's defence was struck out by the judge and they were ordered to make payment, I am told by Bott that this normally does the trick and clients get paid. In our case they have ignored everything and now the high court bailiffs have been instructed.

    I would love to be a fly on the wall when they go in!!!

  • Hi there, we are new to this forum. We have issued court proceedings for flight number TOM573 from Sharm (Egypt) to Manchester which was scheduled for departure on 28 October 2010. This flight was cancelled (no reason given) and rescheduled for departure on 29 October departing 4.17pm. The reason given by Thomson for rejecting our claim was the 2 year rule (we wrote to them originally in 2013!). We are aware of the recent ruling in 2014 reaffirming that the 6 year rule still applies. No other reason has been given for the cancellation of the flight. They have indicated that they intend to provide a full defence against our claim. Has anyone else to your knowledge successfully had a judgement passed in their favour for this flight? BTW we have yet to see their defence. Also, how do we find our the reason for the flight being cancelled as this has not been revealed in correspondence to date?


    We have followed the correct process involving writing to Thompson several times, complaining to the CAA etc. leaving us with no option other than to issue court proceedings.


    Any help/advice would be greatly appreciated, especially if you can provide case law that I can simply extract into my own documentation.
