    Well bad news I"m afraid I sent my claim off on the 17th Dec for this flight and i was told last week that we would not get compensation due to the Technical fault being a manufacturing defect! I am still awaiting the official letter, but we have now put this in the hands of a no win no fee company. It seems now they are trying to wriggle out of paying on technical faults by quoting this latest load of !!!. We will be prepared to go to court if they don't pay up, I'd rather get something rather than nothing for my satisfaction. Feel free to PM me if you want any info.:mad:
  • Hi just wondering if it is worth complaining about our delay we had back in 2006 from Sri lanka to gatwick. We were delayed 17 hrs due to a hold door falling off after take off from gatwick coming to Sri lanka!

    Please advise Boeing or Airbus of this with the aircraft registration, use flightstats and plane finder to get the reg.

    I,d be interested to know if anyone on this flight got anywhere with Thomson.
    I,ve just 2 weeks ago put in a court claim before the 6 years were up.
    Might need some help on here if that's Ok

    Very bad workmanship if you ask me! :D

    If i were boeing I would be sueing for defamation of reputation!

    Dear Sirs,

    On 15th December 2014 I was due to fly on flight TOM113 from Punta Cana to Manchester. This was a flight to be operated by Thomson, a UK based airline.

    The flight was delayed by 25 hours so I subsequently submitted a claim to Thomson as EU laws permit same if the flight was delayed beyond 3 hours.

    Thomson have refused to pay the claim as they state there was a manufacturing defect with the plane concerned and as such they are not responsible. Following research I have ascertained the plane in question was a Boeing manufactured by yourselves. The UK registration is G-OBHY, a B763 Aircraft, model 767, construction number 28883.

    As there was a ‘manufacturing defect’ (as advised by Thomson) with this plane/component of same I write to advise that I hold Boeing responsible for the 25 hour delay to my flight and put you on notice that it is my intention to advise the CAA (Civil Aviation Authority) of the ‘manufacturing defect’ and I reserve the right to pursue an action in the UK courts against yourselves in respect of the losses I incurred.

    Should you not wish me to take this action I would be obliged to receive your response by return.
