    I've been Money Tipped!
    Life has gotten in the way of issuing Court proceedings, I'm now FINALLY getting ready to do so, hoping to have it all done by Sunday. I'm also running out of time, 5 years is up 20 Feb 2015 (delay was 21 Feb 2010).

    eeeeeekkkkk, nervous about it all, but I've downloaded the guide (Thanks Vauban, Dr Watson et al)

    (I was REALLY hoping to avoid issuing court because I'm lazy.....)
  • Apologies first of all if I am posting in the wrong place but I would like to say that I too have received a letter from Thomson today turning down my compensation request due to "extraordinary circumstances".
    Flight TOM 4361 travelling back to Gatwick from Larnaca was delayed due to an aircraft travelling back to Luton from Greece being struck by lightening, therefore meaning there was no aircraft available to pick up the Luton flight from Larnaca. Eventually a larger plane was sent to Larnaca to take back both the flights to Gatwick.


    I believe this to be an operational decision as there was no problem with our aircraft or Gatwick flight but we were delayed due to the issue with no aircraft for the Luton flight. I am just about to respond with an NBA. What do other forum members think, do I have a valid claim?

    I am wondering whether or not this could be a valid claim.

    On December 27th the 14.05 flight from Manchester to Sofia was delayed.

    It was called for boarding at approx 15:00, and after waiting at the gate fr about 20 minutes an announcement was made to return to the waiting area in the lounge. A further announcement was made that passengers on the Salzburg flight were to proceed to the gate where we had been waiting.

    There was a plane already at the gate which we had assumed was ours. Baggage was removed from the plane and replaced. I assume this was the baggage for people going to Sofia being replaced with that of those going to Salzburg.

    Eventually the flight was called for boarding at 18:00 and we took off at 18:30 arriving in Sofia over 4 hours late.

    The pilot said that the delay was because the bad weather at Chambery had meant buses had been unable to make it to the airport and that planes were held to wait for them. He mentioned something about this being the reason for the flight delay although I am not convinced this quite tallies with us already being called for boarding at 3.00pm with a plane at the boarding gate.

    Surely this is an operational decision to switch a flight. My understanding of what happened at Chambery that day is that flights were held to wait for passengers and not because the bad weather prevented planes for taking off or landing.

    I contacted Crystal Ski who I booked with who stated that the decision would have been made either by Thomson or Manchester airport to use the plane at the gate for Saltzburg. I have contacted also the agents I made the booking with.

    Two questions:

    1. Do I have a claim?
    2. Do I go to Thomson direct or via either Crystal or the travel agents?

    Many thanks in advance for any advice given.

    2. The airline direct (the agents are irrelevant for your claim).

  • Hi. Just to give people some hope. I sent my first letter after seeing Martin Lewis on This Morning to Thomson on the 12th November 2014 asking for compensation for a flight delay from Larnaca Airport to Doncaster Airport. The delay was on the 10th may 2011 and we was delayed for more than 6 hours. On the 3rd of January 2015 I received an email from Thomson saying that they will be in a position to reply on the 10th January 2015. Today I have received a second email saying that they are paying out for all three passengers £934.74. Result. I hope this gives some people some hope to keep going.

    Just heard from Bott & Co that they have agreed to pay us.
    This is for flight TOM 6301 Paphos to Exeter 14/12/2011

    I also heard from Bott and Co today. Thomson have agreed to settle our claim for 21/7/14 LGW-MBJ. €3000 minus their fees😀....v happy with Bott and Co.

    I took a return flight on Thomson Dreamliner (787) from Barbados on Friday 09/01/15 to Manchester.

    On the flight a man was taken ill with heart failure and we were diverted to the Azures so he could be removed from the plane.

    Owing to fuel and directives on flying hours for the crew we were forced to stay a minimum of 12 hours in the Azures until we could fly again.

    It is my understanding that the man who fell ill (he was already ill as he was brought on to to the plane strapped into an airport issue wheelchair) self-certified himself fit to fly because he had discharged himself from hospital following a week there, owing to his insurance having run out.

    Am I correct in thinking that because Thomson did not refuse the man to travel that I am entitled to compensation for the 19 hours we were delayed?

    I believe it was a self-certification that the man gave, rather than a doctor's note, therefore is it the same situation as when passengers are drunk and airlines should refuse to let said persons travel?
